We write to express our concern regarding the treatment of Larrakia, Wadjigan, and Central Arrernte senior academic Dr Eddie Cubillo, and other First Nations staff and students at Melbourne Law School. Melbourne University and the Law School Executive have taken inadequate steps to investigate and respond to these issues.

First Nations staff and students have made it clear they are not safe at MLS and MLS has not taken meaningful action to address these issues. First Nations staff and students have not been offered meaningful accountability over processes designed to ensure a safe workplace. 

On Friday the 8th of September, media broke the news of both the treatment of Dr Cubillo by MLS, and First Nations students and staff experiences at MLS.[1]

We note the Vice Chancellor’s apology in 2008 to all Indigenous Australians for “any past wrongs carried out in the name of the University, which have caused distress to Indigenous Australians” and we note that those wrongs continue today. 

The Council of Australian Law Deans (CALD) has clearly noted the complicity of Australian legal education institutions in reifying and supporting systemic discrimination against First Nations people:

"CALD acknowledges the part that Australian legal education has played in supporting, either tacitly or openly, the law’s systemic discrimination and structural bias against First Nations peoples. At the same time, CALD affirms the positive contribution Australian law schools can, should, and will make, in full partnership with First Nations peoples, in exposing, critiquing, and remedying all forms of institutionalised injustice."[4]

Substantial, genuine, empathetic, generous engagements to address the lack of cultural safety at MLS are urgent and necessary. The failure of the institution to take meaningful action on, listen to, and support First Nations staff and students is unacceptable.

Melbourne Law School has been entrusted with the safety of First Nations students and staff. The need for repair and reparation is urgent and in line with Melbourne University’s 2008 Apology. As a matter of urgency, and to demonstrate good faith on the part of MLS:

1. An unreserved apology to First Nations staff and students for  distress incurred because of a lack of cultural safety.
2. A standing committee on anti-racism at Melbourne Law School and Melbourne University that comprises First Nations people who review experiences of direct and institutional racism, including inter alia taking complaints by First Nations students and staff, reviewing the curriculum and assessment for racism, providing input into First Nations recruitment and retention processes, making recommendations on changes for a culturally safer workplace and learning space and forming positions on broader institutional change to combat racism. 
3. A commitment to implement a mandatory Indigenous subject to be included as part of the JD by the beginning of semester 1, 2025. 
4. Meaningful and ongoing, yearly anti-racism training with a focus on First Nations experiences of racism, to be compulsory for all staff at MLS, and this training must be completed before semester 2, 2024 for current staff and within 1 month of beginning at MLS for any new staff.
5.  A commitment to quotas for identified roles within MLS to be at least double the proportion of Aboriginal and Torres Islander people in the Australian community. This should apply to academic and professional staff separately and be staged so that parity with the community be in place by the beginning of semester 1, 2026 and the full quota be met by semester 1, 2030. The doubled quota recognises that the full law of this land prior to colonisation was Aboriginal and Torres Strait Islander, that Aboriginal and Torres Strait Islander peoples have led and had an outsized role in law reform and social change since colonisation, and the social indicators for Aboriginal and Torres Strait Islander peoples continue to be dire. 
6. That these identified roles are permanent, ongoing roles, and academic positions can negotiate yearly about the division of academic/ research/ administration aligned to each position description in order to acknowledge the continuous burden placed on First Nations’ staff to be of service to community. This will allow staff to contribute fully to the culture of MLS and progress in their careers, creating meaningful cultural change.
7. That there be an Aboriginal or Torres Strait Islander identified permanent position be established as a matter of urgency as an advocate and liaison officer for First Nations students.
8. That MLS supports a taskforce within the Council of Australian Law Deans to consider similar problems across Australian Law Schools. 
9. That the full report, findings, and recommendations of the Indigenous Cultural Safety Report currently being commissioned at Melbourne Law School by Abstarr be made public and that MLS publicly commit to implementing its recommendations in advance.
10. That MLS immediately double its funding of identified scholarships for Aboriginal and Torres Strait Islander students and commits to meaningfully fund First Nations lead student initiatives.

We comprise academics and students at Melbourne Law School, academics and students at law schools and other faculties across Australia, and community organisations, and members working in anti-racism and First Nations’ justice. We regard the experiences at Melbourne Law School to be the tipping point of systemic racism across law schools and legal education. Change at Melbourne Law School must equally be implemented at all institutions. Without such change, law faculties entrench racism both within universities and within the legal system. 

Universities should set the standard for social inclusion by rejecting all forms of racial discrimination and creating processes of accountability. All universities should treat this as a moment to undertake their own reckoning over the need for change within their institutions and the importance of that change being led by First Nations staff and students.
