Public Petition for Opening Family Courts to Public Scrutiny

Family courts are responsible for some of the most significant decisions affecting children and families, including custody, care proceedings, and adoption. However, these courts are often closed to the public, which means that decisions made behind closed doors are not subject to proper oversight. This lack of transparency can lead to injustices, including:
Bias and unfair decision-making: Without scrutiny, there is a risk that decisions may be influenced by personal biases, conflicts of interest, or systemic issues that aren’t properly addressed.

Mistreatment of vulnerable families: Families who are involved in care proceedings often have limited access to justice, particularly if they lack the resources to challenge decisions made by social services or judges.
Lack of accountability for mistakes:When mistakes or wrongful decisions are made, there are often few ways for families to appeal or seek redress, leaving them trapped in a system that doesn’t work for them.

The Call for Transparency

We believe that opening family court proceedings to public scrutiny is essential to creating a more just and accountable system. We call for:
1. Public access to family court hearings in non-sensitive cases, where the privacy of the children and vulnerable individuals can be safeguarded while allowing for greater transparency in decision-making.
2. Clearer reporting requirements that allow the public to understand how and why decisions are made, ensuring that judgments are in the best interests of the children involved.
3. Better protection for whistleblowers within the system, so that social workers, lawyers, and others can speak out about corruption, misconduct, or malpractice without fear of retaliation.
4. A review of policies and practices to ensure that all decisions made by family courts are fair, unbiased, and based on thorough evidence.

Why This Is Important

The family court system has a profound impact on families, particularly children, who are at the center of these proceedings. When decisions are made behind closed doors without sufficient oversight, it can erode public trust in the system. We want to ensure that the family courts are working in the best interests of children and families, not in secrecy, and are held accountable for their actions.

What We Are Asking For
We ask the Welsh Government and the UK Government to:
1. Launch a public inquiry into the transparency and accountability of family courts, including the possibility of opening family court hearings to public scrutiny where appropriate.
2. Review the current legal framework around family court proceedings to ensure greater fairness and accessibility for families, especially those who are disadvantaged or vulnerable.
3. Introduce reforms to provide stronger protection for whistleblowers within social services and the family court system.

It is time for the family court system to operate with the transparency and accountability it requires to earn the trust of the public and serve the best interests of children and families. We believe that greater scrutiny of these courts will help prevent injustice, reduce the risks of systemic bias, and improve outcomes for all families.
