Dear President of the IOC,

The practice of sports is a universal right, regardless of one's origin, gender, opinions, or religion. In the Islamic Republic of Iran, women face multiple forms of discrimination, not only in their daily lives and the enjoyment of their rights but also in the field of sports:
they are forbidden from attending stadiums, prohibited from participating in certain sports (boxing, gymnastics, wrestling, swimming, beach volleyball), and required to wear Islamic attire in the sports they are allowed to engage in, and more.

These discriminations are clear violations of the Olympic Charter (Article 59-1), which states that "The practice of sport is a human right.

Every individual must have the possibility of practicing sport, without discrimination of any kind" and that "Enjoyment of the rights and freedoms set forth in this Olympic Charter shall be secured without discrimination of any kind, such as race, color, sex, sexual orientation, language, religion, political or other opinion, national or social origin, property, birth or other status."

In case of a violation of the Olympic Charter, it is the responsibility of the IOC Executive Board to sanction the Iranian Olympic Committee by suspending it (Article 59). Even if the Iranian Olympic Committee were to argue in vain that these discriminations against women are imposed by the government of the Islamic Republic, the Olympic Charter also states that national committees "must maintain their autonomy and resist all pressures, including political, legal, religious, or economic pressures, which may prevent them from complying with the Olympic Charter" (Article 27-6). This is what the IOC reminded us of when it excluded the South African Olympic Committee for twenty years in 1971 due to apartheid policies in sports.

 

It will not escape your notice that there are strong similarities between the racial discriminations sanctioned in 1971 and the gender-based discriminations currently in effect in Iran, which resemble a "sexual apartheid."

For these reasons, we request that you present a proposal to the IOC Executive Board for the suspension of the Iranian National Olympic Committee until they demonstrate compliance with the fundamental principles of Olympism.

At the very least, if the Executive Board does not impose this sanction, it should refuse Iran's participation in the 2024 Games in the five sports that are closed to women. Indeed, Article 44-4 of the Charter stipulates that national Olympic committees must ensure that their federations have not excluded any athletes "on racial, religious, political, or other grounds of discrimination," and allows the IOC to refuse any registration for the Olympics in such cases.

La pratique du sport est un droit universel, quels que soit l’origine, le sexe, les opinions ou la religion des personnes.  

En République Islamique d’Iran, les femmes sont l’objet de multiples discriminations, non seulement dans la vie courante et la jouissance de leurs droits, mais aussi dans le domaine du sport : interdiction de se rendre au stade, interdiction de pratiquer certaines disciplines sportives (boxe, gymnastique, lutte natation, volley de plage), obligation de porter la tenue islamique dans les disciplines qui leur sont autorisées, etc. 

Ces discriminations constituent des violations évidentes de la Charte Olympique (article 59-1), qui disposent que « La pratique du sport est un droit humain. Toute personne doit avoir le droit de pratiquer un sport sans discrimination d’aucune sorte » et que « La jouissance des droits et libertés reconnus par la Charte doit être assurée sans discrimination d’aucune sorte, notamment en raison de la race, la couleur, le sexe, l’orientation sexuelle, la langue, la religion, les opinions politiques, l’origine sociale, la naissance, ou autres ». 

En cas de violation de la Charte Olympique, il appartient à la commission exécutive du CIO de sanctionner le comité olympique iranien en prononçant sa suspension (article 59). Vainement, ce dernier ferait-il valoir que ces discriminations à l’encontre des femmes lui sont imposées par le gouvernement de la République Islamique : là encore, la Charte Olympique dispose que les comités nationaux « doivent préserver leur autonomie et résister à toutes les pressions, y compris les pressions politiques, juridiques, religieuses ou économiques, qui pourraient les empêcher de se conformer à la Charte olympique » (article 27-6).

 

C’est ce qu’a rappelé le CIO lorsqu’il a exclu en 1971, pour vingt ans, le comité olympique d’Afrique du sud en raison de la politique d’apartheid dans le sport. 

Or, il ne vous échappera pas qu’il y a de forte similitudes entre les discriminations raciales sanctionnées en 1971 et les discriminations selon le genre en vigueur en Iran, qui s’apparentent à un « apartheid sexuel ». 
Pour ces raisons, nous vous demandons de saisir la commission exécutive du CIO d’une proposition de suspension du comité national olympique d’Iran jusqu’à ce qu’il justifie s’être conformé aux principes fondamentaux de l’olympisme. 

A minima, si la commission exécutive ne prononçait pas cette sanction, elle devrait refuser l’inscription de l’Iran aux prochains jeux de 2024 dans les cinq disciplines qui sont fermées aux femmes. En effet, l’article 44-4 de la Charte prévoit que les comités olympiques nationaux doivent s’assurer que leurs fédérations n’ont écarté aucun athlète « pour des raisons raciales, religieuses, politiques ou en raison d’autres formes de discrimination » et permet au CIO de refuser alors toute inscription aux JO.

آقای رئیس کمیته بین‌المللی المپیک

تمرین و فعالیت در ورزش، حق جهانی است که باید برای همه افراد بدون تبعیضی از نظر نژاد، جنسیت، دین یا عقاید مذهبی فراهم شود. در جمهوری اسلامی ایران، زنان با مضاعفه تبعیض‌ها روبرو می‌شوند، نه تنها در زندگی روزمره و اجتماعی و در ادعای حقوق شان، بلکه در زمینه ورزش نیز: ممنوعیت حضور در ورزشگاه، ممنوعیت انجام برخی رشته‌های ورزشی (مانند باکس، ژیمناستیک، کشتی، شنا، والیبال ساحلی)، اجبار به پوشش اسلامی در رشته‌هایی که اجازه شده است و مواردی از این دست.

این تبعیض‌ها نقض‌های آشکار به شرط‌العمل المپیکی (ماده 59-1) محسوب می‌شوند که می‌گوید: "تمرین ورزش، حق بشری است. هر فرد باید امکان تمرین ورزش را بدون هیچگونه تبعیضی داشته باشد" و همچنین آمده است: "لذت بردن از حقوق و آزادی‌هایی که در این کده المپیک تعیین شده است، بدون هیچگونه تبعیضی از نظر نژاد، رنگ، جنسیت، جنسیت‌گرایی، زبان، دین، عقاید سیاسی، نژادی، اصلی، مکان تولد یا موارد دیگر تضمین شده است."

در صورت نقض کده المپیکی، وظیفه هیات اجرایی کمیته بین‌المللی المپیک (IOC) است که کمیته المپیک ایران را با تعلیق مجازات کند (ماده 59). حتی اگر کمیته المپیک ایران بی‌فایده به دفاع از این نقض‌ها به خاطر دولت جمهوری اسلامی می‌پرداخت، کده المپیک همچنین تصریح می‌کند که کمیته‌های ملی "باید استقلال خود را حفظ کنند و مقاومت کنند در برابر هرگونه فشار، از جمله فشارهای سیاسی، قانونی، مذهبی یا اقتصادی که ممکن است از اجرای کده المپیکی جلوگیری کند" (ماده 27-6). این مسئله را همان چیزی است که IOC در سال 1971 هنگامی که برای بیست سال کمیته المپیک آفریقای جنوبی را به دلیل سیاست‌های جدایی‌انگیز در ورزش از بازی‌های المپیک خارج کرد.

به سختی می‌توان نادیده گرفت که تشابه‌های قویی بین تبعیض‌های نژادی که در سال 1971 مورد تأیید قرار گرفت و تبعیض‌های جنسی که در ایران وجود دارند و به نظر می‌آید تا حدودی به یک "جدایی جنسی" شباهت دارند.

به همین دلیل، از شما درخواست می‌کنیم که یک پیشنهاد برای تعلیق کمیته ملی المپیک ایران به علت تطابق با اصول اساسی المپیسم به هیات اجرایی کمیته بین‌المللی المپیک ارائه دهید.

حداقل، اگر هیات اجرایی این مجازات را تعلیق نکند، باید شرکت ایران در بازی‌های المپیک 2024 در پنج رشته که برای زنان بسته است، را رد کند. به واقعیت، ماده 44-4 از کده المپیک تعیین می‌کند که کمیته‌های المپیک ملی باید تضمین کنند که فدراسیون‌هایشان هیچ ورزشکاری را "به دلایل نژادی، مذهبی، سیاسی یا دلایل دیگر تبعیض‌آمیز" از مشارکت محروم نکرده‌اند و به IOC اجازه می‌دهد که در چنین مواردی ثبت‌نام را رد کند.
