Petition to Overturn Brittany Poolaw’s Conviction of First Degree Manslaughter

The Issue

On October 6th, 2021 Brittany Poolaw was sentenced to four years in prison following a conviction of first degree manslaughter after suffering a miscarriage at 17 weeks pregnant. The prosecution argued that the death of the fetus was caused by Poolaw’s use of methamphetamine, although the official cause of death could not be determined due to the possibility that a placental abruption not related to the methamphetamine use could’ve been the cause. Either way, this is an incredibly dangerous and slippery slope in regards to women’s rights and Brittany’s situation is not a crime under Oklahoma state law as the prosecution argued. Brittany has already spent a year and a half in jail waiting for her trial, and after suffering such an incredible loss that has caused her significant trauma she has now fallen victim to this country’s systemic oppression against women.
