EDUCATION FOR ALL 

Do all special need children have right to get equal education in mainstream? Yes you know every child deserves an equal opportunity to learn and Education is a basic fundamental right under article 21.

I am writing this petition in favor of thousands of special need children in Jammu & Kashmir, so that they gets their equal rights in education under (Inclusive Education) in all Private schools as per RPWD Act 2016, RTE 2009 and National Education Policy. 

I would like to bring your attention to the fact that Jammu and Kashmir currently has a large number of children with different disabilities. Here in J&K Private educational institutions didn’t allow CWSN in mainstream under inclusive education. Most of the parents of special need children have approached different private schools time to time for admission but school didn’t show any responsibility towards admission for special need children as per RPWD Act 2016 and RTE 2009. Most of the children cross 18 years without basic education. 

As we know after Abrogation of article 370 all central laws is applicable in our UT. Also, to quote Right to Person with Disability Act 2016 is now implemented in Jammu & Kashmir UT and as per this act every school should give admission to every special child in mainstream. Before 2 years Government of Jammu & Kashmir already has implemented RPWD Act 2016 but schools still didn’t allow special children’s in mainstream. In 2020 i  admitted PIL in J&K High court and court mentioned in judgement Government will frame rules related to inclusive education but till date nothing happen on grounds. The parents of thousands of special need children wants:

1. Allow special need kids in mainstream under inclusive education in all private schools as per RPWD Act 2016, and RTE 2009.
2. Start Vocational Training's centers for Adult special children. 
3. Appoint special educators in every Govt as well as private schools. 

I want Govt Education Department  intervene in this matter and help these parents and special need kids, so that thousands of special needs children’s get admission in different private schools in valley which would be the “Best Interest of Child” which is the focal axis of the Child Protection Policy.
