The Issue
Bergbron, Randburg, do hereby object to the above proposed amendment on the basis that it is undesirable for the area. See details at the bottom. If you need I more details. I will provide the details of my objection at the relevant Town Planning hearing
Background
Planning application has been made on Erf 65 Bergbron which is the site of the old Leephy recording studios where, among other things, foreign television drama was dubbed into Afrikaans to satisfy demand in the early days of television in South Africa. At that time Phillips road was the main east- west road serving Bergbron. Gordon Road took over those functions later. Erf 65 was then zoned for limited business purposes intended for shops but Gordon Road created a new axis for such use. The owner of the land was and still is a company called Leephy Prop (Pty) Ltd.
Years ago Leephy left the property with is building and sold the company to a Mr Prior who lived there with his family from some time. Since then the property has been occupied by Ms Sharon Khan who apparently was Mr Prior's assistant. The shareholding of Leephy Prop is unknown but Ms Kahn is now the sole director and has been trying to sell the land with new rights. She attaches to the Christian religion and firstly obtained Consent Use rights to operate an orphanage and nursery school in which it seems she wanted to be involved. For some reason, likely the absence of an investor who would fund the creation and operation of the orphanage and nursery school, these rights have been dormant or are lapsed. However she now wants to get a further Consent Use right for a church to run in tandem with the nursery school.
It is important to understand that Consent Use rights attach to property, not to its owner or occupier. So if Ms Kahn leaves, another party may exploit these rights without further application. The new Consent Use rights seem to have been applied for by Ms Kahn herself, not a Town Planner. The "agent" whose name appears on notices is a legally resident Nigerian immigrant whose name is unclear-possibly a Mr Theophilus Oluwaseeki. Why he should be involved is unknown but others of his nation of origin have been notably involved in the establishment of a number of emotionally- styled churches in South Africa.
It seems obvious that there is an investor/operator in the wings to put effect to Ms Kahn's application for a church. Several questions (some listed below) come to mind to validate objection to the application. Residents are entitled to protect the reputation and character of their suburb. Objections must be emailed before 30 November 2023 to;
(1) Objections Planning@joburg.org.za (referring to proposed Consent Use on Erf 65 Bergbron)
- Who are the shareholders of Leephy Prop (Pty) Ltd?
- Why did Ms Sharon Kahn not act as the agent in this application?
- What is Mr Theophilus Oluwaseeki's involvement of the application for a church?
- What church organisation is proposed or intended to operate the church National or International?
- How can the "church" be regarded as needed or desirable without any information About its specific denomination, maximum attendance numbers, times of worship, anticipated parking spaces, where is the members from where do they stay etc?
- What skilled persons or organisation is proposed to operate the nursery school? How will the nursery school be funded?
Any other questions that probe the impact and sustainability of the proposed activities
