NSW Premier Chris Minns: Allow medical cannabis patients to legally drive

The issue

Dear Premier Chris Minns,

I hope this letter finds you well. I am writing to raise an urgent issue affecting medical cannabis patients in New South Wales: the driving laws relating to prescribed cannabis treatment.

At present, patients who are legally prescribed medical cannabis face the risk of losing their licences simply because current roadside testing protocols detect the presence of cannabinoids, rather than impairment. This means that individuals who are following their doctor’s instructions and are not impaired in any way can still be penalised, criminalised, and stripped of their ability to drive.

For many patients, driving is not optional - it is essential for accessing medical care, employment, education, and supporting their families. Stripping them of this right purely on the basis of trace detection, without evidence of impairment, is unjust and discriminatory.

A fairer system is urgently needed - one that aligns medical cannabis with other prescription medications. Specifically, testing protocols should measure impairment levels, not the mere presence of cannabinoids, to ensure both road safety and patient rights are protected.

I urge you to take leadership on this matter and act to reform NSW’s driving laws for medical cannabis patients. By doing so, you will be safeguarding the dignity, mobility, and livelihoods of thousands of people across the state.
