City of Northglenn, overturn your illegal order and release illegally seized dog

The Issue

My dog was taken on September 26, 2014 when local law enforcement kicked down the door to the property where my dog was at. My dog ran out of the kicked down door in fear, and they picked them up at a house about a half mile away, scared and bleeding. The citizen who's home he was picked up from after he ran, reported him to the city as extremely friendly. They also took my other dog from the home on the same day, however she was released just a few days after impoundment. The Northglenn municipal code states that within 8 hours of a dog being impounded the city MUST make a record of why that dog was impounded. The city did not do that for the released dog nor the dog they are still holding.

In February the city called me and told me that I could go pick up my dog but had to do so within 5 days, or he would become property of the state. I went 3 times within those 5 days to pick him up and on the final time, Northglenn police showed up and told me they were going to hold a hearing on the disposition of my dog (released or euthanasia). This hearing (Case Number AC-2015-9) was held illegally under Northglenn Municipal Code. There were no Northglenn summons or complaints against my dog to give them the authority to hold a dispositional hearing regarding my dog. The judge illegally deemed my dog as needing to be euthanized based on hearsay documents from the animal shelter. I was also denied these hearsay documents when requested a few days prior to the hearing, leaving me with an inability to have any reason to request subpoena on the animal shelter workers. One of these documents had statements, but no signature, I had a video disproving the claims in the other.

Northglenn Municipal Judge deemed my dog needing to be euthanized. Because I knew that the municipal hearing on disposition of my dog was illegal, I appealed this order, and my appeal is now waiting to be accepted or denied at the Supreme Court level. I have been paying a $7 daily fee to keep my dog alive, while this appeal has been going on as if I do not pay this fee they will euthanize him. I have been paying this fee for my dog for over a year. To this day, I continue to awaiting justice for not only my dog and his life, but regarding the infringement this situation has had on my constitutional rights as well.

I reached out to a local animal attorney, and have retained her as counsel. She has put in a request to Northglenn Municipal Judge to overturn her illegal euthanasia order, which based on Northglenn Municipal Code this euthanasia order is technically a sentence. Therefore my dog was sentenced to euthanasia, without there being any criminal summons or complaints issued. This request has not been approved or denied thus far, and i would like to have this petition available to give to the courts so the Judge can see that citizens agree that Municipal cities cannot infringe upon a persons constitutional rights, and so that she will overturn her illegal order and release my dog back where he belongs and never should have been kept from.

I have uploaded a video to show anyone who sees my petition just how well behaved my dog is. This video was taken after he had been in that same cage for 6 months straight. He has continued to be in that cage for now a total of slightly over a year and a half. Thank you for reading, and signing my petition.
