North Carolina General Assembly and Governor Pat McCrory: Oppose HB 34 (Clarify Indecent Exposure Law)
The Issue
Uphold individual freedoms and municipal rights!
Elected officials are elected to serve all of their constituents, not simply the most vocal. As a law maker, your obligation is to limit the influence of government at the highest levels and enable localized and individual freedoms to establish their own governances.
In opposition to "clarification" of the definition of "private parts" proposed in HB34, we ask that you reconsider any support for this measure.
The question is not one in support of free, unfettered public exposure or overriding of public indecency laws, but rather the empowerment of local municipalities to establish their own ordinances in accordance with the wishes of the local population.
Establishment of sweeping state-wide laws designed to strip away individual rights, ANY rights, does not match up with the spirit of either party's platform or long term approval ratings. I challenge that no voter will re-elect any legislator based on the elimination of a civil right. When polled, the vast majority of citizens support strong individual freedoms, and this bill serves only to publicly restrict said freedoms.
We ask that you consider this bill carefully before voting and separate yourself from the visceral topic in said bill. Overlook the squeamishness of a small portion of your voting public and determine what is the positive outcome of intentionally eliminating an person's individual freedom, regardless of what that freedom may be, understanding that municipalities will STILL have every right to enact the exact same laws, but within the societal constraints of their own districts, not hundreds of miles away in Raleigh.
Were the balance of power in Raleigh reversed, I know small municipalilities would still want to retain their rights to enact laws that may be contrary to a Democratically controlled Legislature and Executive office.
