Let's jump right into it!
There is a lot of red tape surrounding access to the hard case files for our 2007 case. Our attorneys are still working on finding the path to exoneration for Michael. We are still in pursuit of getting the internal Vaginal DNA results.
The downfall of this case is the guilty plea document. It looks like he signed off for all three charges. Michael says that he thought that he was signing a plea deal for UP to twenty years for burglary only. However, our attorneys have informed us that because the court was going for recividism, there was only maximum sentencing. The sentencing ranges that were given were invalid for this case.
Clearly, everything on the guilty plea document was not there when he signed off for burglary, but despite all the errors and prosecutorial misconduct, we cannot seem to get past the lateness to argue anything. His appellate rights have been expired. He could not get fair representation in a timely manner. It is like the truth does not matter. The truth does not seem to be good enough.
