Last week more than 30 people submitted complaints to the IUB to stop them from allowing Dakota Acces to commence construction without the USACE permit. This week they've retooled their order and are asking DA to give actual evidence of adverse impacts to landowners if they are not allowed to begin construction right away without the USACE permit. They have until tomorrow 5/10 to comply. We need to submit complaints today for the greatest impact. Our feeling is that the negative impact of building without the permit is greater. Please join us in filing a complaint to this effect. Here is my complaint: "The IUB's request that Dakota Access prove adverse impacts to landowners in light of construction delays seems to be a move in the right direction. However, the IUB has a responsibly to verify and ensure that evidence of adverse impacts to landowners if construction is not allowed to proceed in advance of the USACE permit will vastly outweigh adverse impacts to landowners if construction is allowed and the USACE permit is not issued this year or at all. In light of the serious concerns brought by the Standing Rock Sioux and other tribes in North Dakota, South Dakota and Iowa the chances of the federal permit actually being approved as it stands are dwindling rapidly. Multiple federal agencies, including the Department of the Interior and the Environmental Protection Agency have voiced their concerns about the USACE permit process and the lack of an overall Environmental Impact Statement (EIS) or adequate consultation with federally recognized tribes. The EPA has gone so far as to request a second draft Environmental Assessment and a full EIS. This is serious business. Not only are the Bakken oil fields responsible for hundreds of toxic spills in the region- impacting drinking water through North and South Dakota already- the proposed pipeline crossing is only 1 mile upstream from the Standing Rock Sioux water intake on the Missouri River. Iowans do not want to be a party to this ongoing environmental injustice and there is a strong case for the USACE to significantly delay or deny the permit. In the event that the USACE permit does not come through- allowing construction to proceed without it would create certain hardship for landowners and the public - as there is NO plan in place for how DA will clean up unfinished construction if they are NOT permitted to build the pipeline across the Mississippi and Missouri Rivers according to the plans they've brought forward. This would leave the people of Iowa holding the bag, again. Allowing Dakota Access to rush forward without all of their permits firmly in place would be a rash and very poor decision for the people of Iowa. You wouldn't let a teenage child drive your car alone on a learner's permit just because he's in driver's ed and you expect him to finish it this semester, would you? No. You wouldn't. The responsible thing is to keep the original agreement. No license, no car. No permit, no pipeline."
