No Tax Abatement for the Lake O’ the Pines Watershed Solar Project
The Issue
PETITION TO MARION COUNTY COMMISSIONERS COURT
Protection of Lake O’ the Pines Watershed and Responsible Development
TO THE HONORABLE MARION COUNTY COMMISSIONERS COURT:
We, the undersigned residents, landowners, and stakeholders of Marion County, Texas, respectfully submit this petition in support of protecting the water quality, environmental integrity, and long-term sustainability of Lake O’ the Pines and its surrounding watershed.
WHEREAS:
Lake O’ the Pines is a vital regional resource supporting drinking water, recreation, wildlife habitat, and local economic activity; and
Increasing development within Marion County, including large-scale commercial and energy projects, has the potential to impact the watershed if not properly managed; and
Well-documented environmental risks include sediment runoff, soil erosion, nutrient loading, and stormwater discharge carrying contaminants into waterways; and
Such risks can be effectively reduced or prevented through proper planning, engineering controls, and oversight prior to construction; and
Tax abatements associated with large-scale projects may shift financial burden onto local taxpayers when long-term benefits are uncertain or limited;
NOW, THEREFORE, WE RESPECTFULLY REQUEST:
That the Marion County Commissioners Court take reasonable and lawful measures, consistent with its authority under:
Texas Health and Safety Code Section 121.003
to ensure that large-scale developments within the watershed are reviewed and conducted in a manner that protects public health, safety, water quality, and the financial interests of county residents.
SPECIFICALLY, WE REQUEST THAT THE COUNTY:
Require submission of engineered drainage, stormwater, and erosion control plans for all large-scale commercial and energy projects prior to the commencement of site work
Ensure implementation of stormwater management practices designed to prevent sediment and contaminants from entering waterways connected to Lake O’ the Pines
Confirm coordination with local emergency services and require appropriate response planning for potential industrial incidents
Allow for reasonable, time-limited review periods where credible concerns exist regarding water quality, infrastructure capacity, or public safety
Decline the use of tax abatements for large-scale energy or industrial projects of this magnitude unless and until clear, measurable, and long-term economic benefits to Marion County residents are independently demonstrated
STATEMENT OF INTENT
This petition does not seek to prohibit lawful development or infringe upon private property rights. Rather, it seeks to ensure that development proceeds responsibly, that public resources are protected, and that local taxpayers are not placed at unnecessary financial risk.
CONCLUSION
Protecting Lake O’ the Pines protects the health, safety, and economic stability of Marion County. We respectfully urge the Commissioners Court to adopt a measured and proactive approach to watershed protection, responsible development, and fiscal accountability.
