We hereby declare That
Change in sharia is not acceptable to Muslim community in India. Muslims are bound to follow Sharia in religious & personal matters.
India’a cultural diversity is the strength and to follow our religions in a predefined manner is our fundamental right.
We as true Muslim, as true Indian and a responsible human being, understand there is no place for injustice in sharia personal laws, there is a lack of a complete knowledge.
Muslim sharia especially around marriage, divorce, inheritance, adoption, maintenance, Wakf etc. are most practical, women’s rights protection centric, only people who don’t have complete knowledge about sharia are creating a wrong perception.
Our family or friends or relatives or neighborhood Muslim women are not in favor of uniform civil code. All women are happily, satisfied with Sharia law & All India Muslim Personal Law board.
Above fact can be understood by showcased unity by all Muslim organizations which fundamentally are of different school of thought. Unanimously opposed any change in sharia law and completely against uniform civil code.
All Muslim organizations have rejected the questionnaire prepared by the Law commission & intent is also explicitly expressed that uniform civil code is unacceptable to Muslim community.
A honest appeal been filed to not interfere about Sharia’s personal laws by All Muslim organizations to law commission of India.
Community feels that questionnaire is law commission’s initiative just to finish Muslim’s personal laws. By referring to article 44 of the constitution, an attempt is being made to give a constitutional position to Uniform Civil code. This is false. Because clause is a Directive Principle which is not bound to be implemented.
As far as the constitution is concerned basic importance is for the fundamental rights. As per article 25 of the fundamental rights, each and every individual has the right to follow, practice and propagate the religion of his/her choice.
Revered courts have time and again upheld the fact that fundamental rights are supreme. If Authorities are really concerned about implementing directive principles, then prime focus should be on implementing such articles of the Directive Principles that are directly connected with wellbeing & welfare of the public i.e. total prohibition, universal education for all children, provision of health facilities to all, toilets in all households etc.
Indian Muslim or any other cast's Indian doesn’t disputes with provisions which are essential for the nation's progress and development.
It is a false illusion that uniform civil code will bring national integration. Imposing uniform civil code will invite disunity and disintegration instead of integration because India’s biggest strength is cultural diversity & freedom of following religious & cultural Personal laws by respective religion's follower.
UCC will create a sense of deprivation in the minds of minorities which will be detrimental to the nation.
People of the country following diverse faiths – Hindus, Muslims, Christians, Buddhists, and Sikhs etc. jointly fought for freedom and liberated the nation from the clutches of the British.
The Indian constitution is also framed on the foundation of unity in diversity. People following different faiths and beliefs take part in the social life following their religious beliefs independently and keeping this diversity and differences they still work together for the progress and security of the country as a joint nation and society.
India is a nation of different religions, cultures and dialects. We have many tribal groups who are brought to the mainstream with whom agreements and assurances were made about no interference in their cultural identity and its safety. Such steps of forcing or driving Uniform Civil Practice will be a big injustice with all who were promised freedom of following their religion.
India is nation of diverse cultures and different religions. Personal laws of all these groups are derived from religious texts or scriptures and has a unique relevance in their cultural identity. Therefore any kind of interference in this is not only a violation of religious freedom enshrined in the constitution, but will put an end to their unique cultural identity.
The questionnaire initiative of law commission has ignited a national level discussion which gives an impression that personal laws are responsible for social inequalities and gender disparities and have nullified the rights of women.
Main topic of debate seems to be framed to target a particular religious group and their personal law. Intention of the affidavit by the central government relating to the issues of triple Talaq, polygamy, maintenance of divorcees etc. All such kind of initiatives or discussions looks to be aimed at clearing the way for Uniform Civil Code.
Any interference in religion centric sensitive matters disrupt the communal harmony and social fabric. India certainly has many better priorities I.e. Unemployment, child labor, poverty, crime control, health care, literacy, communal harmony etc. which shall be focus area for debate & implementations which can make India progressive & developed country.
This petition is an appeal to all peace and justice loving people of the country to oppose Uniform Civil Code move.

हमारी ताकत हमारी सांस्कृतिक विविधता है, और एक पूर्वनिर्धारित तरीके से हमारे धर्म का पालन करने के हमारे मौलिक अधिकार है।
हम एक सच्चे मुसलमान, एक सच्चे भारतीय और एक जिम्मेदार इंसान, बहुत अच्छी तरह से समझते हैं कि मुस्लिम पुरुष या महिला जो शरीयत का पालन में बंधे हुए हैं, उन्हें हमेशा न्याय मिलता है, लोगों को शरीयत के बारे में पूरी तरह से पता होना चाहिए।
विशेष रूप से विवाह, तलाक, विरासत, गोद लेने, रखरखाव आदि के बारे में मुस्लिम शरीयत सबसे व्यावहारिक हैं और महिलाओं के अधिकारों के संरक्षण पर केंद्रित। केवल कुछ ही लोगों को एक गलत धारणा है, उन्हें शरीयत के बारे में पूरी जानकारी नहीं है।
मेरे परिवार के सदस्यों, दोस्तों, रिश्तेदारों, पड़ोस के मुस्लिम महिलाओं में से कोई भी समान नागरिक संहिता के पक्ष में नहीं हैं। इन सभी महिलाओं को बहुत खुशी से शरीयत कानून और ऑल इंडिया मुस्लिम पर्सनल लॉ बोर्ड से संतुष्ट हैं।
इस तथ्य को सभी मुस्लिम संगठनों जो मौलिक रूप से अलग अलग विचार धारा के हैं द्वारा प्रदर्शित एकता से समझा जा सकता है। सभी ने सर्वसम्मति से शरीयत कानून में किसी भी परिवर्तन का विरोध किया, और पूरी तरह से समान नागरिक संहिता के खिलाफ है।
सभी मुस्लिम संगठनों प्रश्नावली विधि आयोग और आशय द्वारा तैयार खारिज कर दिया है, यह भी स्पष्ट रूप से व्यक्त की है कि समान नागरिक संहिता मुस्लिम समुदाय के लिए अस्वीकार्य है।
एक ईमानदार अपील भारतीय विधि आयोग को सभी मुस्लिम संगठनों द्वारा शरीयत के व्यक्तिगत कानूनों के बारे में हस्तक्षेप नहीं करने के लिए दायर की गई।
समुदाय का मानना है कि प्रश्नावली सिर्फ मुस्लिम पर्सनल लॉ खत्म करने के लिए कानून आयोग की पहल है। संविधान के अनुच्छेद 44 का हवाला देते हुए, एक प्रयास समान नागरिक संहिता को एक संवैधानिक स्थिति देने के लिए बनाया गया है। यह गलत है। क्योंकि खंड एक निर्देशक सिद्धांत है, और लागू करने के लिए बाध्य नहीं है।\

श्रद्धेय अदालतों ने समय समय पर इस तथ्य को सही ठहराया कि मौलिक अधिकार सर्वोपरी हैं। अधआधिकारिक निर्देश के सिद्धांतों को लागू करने के बारे में वास्तव में चिंता अगर हैं तो प्राइम फोकस निर्देशक सिद्धांतों कि सीधे भलाई, कुल शराब निषेध, सभी बच्चों के लिए सार्वभौमिक शिक्षा, एवम स्वास्थ्य के प्रावधान ,जनता के कल्याण के साथ जुडे निर्देश , सभी के लिए सुविधाएं, सभी घरों में शौचालयों आदि इस तरह के लेख को लागू करने पर होना चाहिए।
किसी भी प्रावधान से जो देश की प्रगति और विकास के लिए आवश्यक हैं। कोई भी भारतीय मुसलमान या अन्य धर्म के किसी भी भारतीय को आपत्ति नहीं है।
यह एक झूठा भ्रम है कि समान नागरिक संहिता राष्ट्रीय एकता लाएगा। समान नागरिक संहिता लगाने से एकीकरण के बजाय, एकता का अभाव पैदा होगा और विघटन आमंत्रित होगा । क्योंकि भारत की सबसे बड़ी ताकत और सांस्कृतिक विविधता संबंधित धर्म के अनुयायी द्वारा धार्मिक और सांस्कृतिक व्यक्तिगत कानूनों का पालन करने की स्वतंत्रता है। यूसीसी से अल्पसंख्यकों के मन में अभाव की भावना पैदा होगी। जो देश के लिए हानिकारक होगा।
देश के लोग विभिन्न धर्मों का पालन करते हैं - हिंदू, मुस्लिम, ईसाई, बौद्ध, सिख आदि ने संयुक्त रूप से स्वतंत्रता के लिए लड़ाई लड़ी और अंग्रेजों के चंगुल से देश को मुक्त कराया।
भारतीय संविधान भी विविधता में एकता की नींव पर तैयार किया गया है। विभिन्न धर्मों और विश्वासों के बाद लोगों स्वतंत्र रूप से प्रगति की तरफ एक समाज की रूप में संयुक्त राष्ट्र और देश की सुरक्षा के लिए एक साथ इस विविधता और मतभेदों को रखते हुए भी सामाजिक जीवन में भाग लेते हैं।
भारत विभिन्न धर्मों, संस्कृतियों और बोलियों का देश है। कई आदिवासी समूहों को मुख्यधारा में लाया जाता है, जिनके साथ समझौते और आश्वासन किए गए थे कि कोई हस्तक्षेप उनकी सांस्कृतिक पहचान में नहीं किया जाएगा और वह वह सुरक्षित हो जाएगा। जबरन समान नागरिक अभ्यास के लिए कदम उठाना जो सभी को अपने धर्म का पालन करने की स्वतंत्रता के किये किये गए वादे के खिलाफ होगा जो एक बड़ा अन्याय होगा।
भारत विविध संस्कृतियों और विभिन्न धर्मों का राष्ट्र है। सभी समूह निजी कानून उनके धार्मिक ग्रंथों या शास्त्रों से प्राप्त कर रहे हैं ,और यह उनकी सांस्कृतिक पहचान में अद्वितीय प्रासंगिकता है।
इसलिए इस मामले में हस्तक्षेप करना किसी भी तरह से न केवल संविधान में निहित धार्मिक स्वतंत्रता का उल्लंघन है, बल्कि हमारी अद्वितीय सांस्कृतिक पहचान को समाप्त कर देना है। जो हमे किसी भी शर्त या क़ीमत पर मंज़ूर नहीं हो सकता।
विधि आयोग की प्रश्नावली पहल से एक राष्ट्रीय स्तर की चर्चा को प्रज्वलित करने से जो एक धारणा बन रही है कि निजी कानून सामाजिक असमानताओं और लिंग असमानता के लिए जिम्मेदार हैं और इसमे महिलाओं के अधिकारों को कोई महत्व नहीं है।

People of the country following diverse faiths – Hindus, Muslims, Christians, Buddhists, and Sikhs etc. jointly fought for freedom and liberated the nation from the clutches of the British.
The Indian constitution is also framed on the foundation of unity in diversity. People following different faiths and beliefs take part in the social life following their religious beliefs independently and keeping this diversity and differences they still work together for the progress and security of the country as a joint nation and society.
India is a nation of different religions, cultures and dialects. We have many tribal groups who are brought to the mainstream with whom agreements and assurances were made about no interference in their cultural identity and its safety. Such steps of forcing or driving Uniform Civil Practice will be a big injustice with all who were promised freedom of following their religion.
India is nation of diverse cultures and different religions. Personal laws of all these groups are derived from religious texts or scriptures and has a unique relevance in their cultural identity. Therefore any kind of interference in this is not only a violation of religious freedom enshrined in the constitution, but will put an end to their unique cultural identity.
The questionnaire initiative of law commission has ignited a national level discussion which gives an impression that personal laws are responsible for social inequalities and gender disparities and have nullified the rights of women.
Main topic of debate seems to be framed to target a particular religious group and their personal law. Intention of the affidavit by the central government relating to the issues of triple Talaq, polygamy, maintenance of divorcees etc. All such kind of initiatives or discussions looks to be aimed at clearing the way for Uniform Civil Code.
Any interference in religion centric sensitive matters disrupt the communal harmony and social fabric. India certainly has many better priorities I.e. Unemployment, child labor, poverty, crime control, health care, literacy, communal harmony etc. which shall be focus area for debate & implementations which can make India progressive & developed country.

A single word from Muslim sharia cannot be changed. Any interference in Muslim personnel laws is not permissible, Muslim sharia Personal laws are derived from the Quran and Hadith and are in unison with the needs and aspirations of human beings. We have a strong conviction that if law commission goes through complete sharia understanding they shall see the kind of scope is given for right's protection of women. Sharia based personal laws very strongly favors underprivileged, week, righteous women, men & children.

शरीयत में परिवर्तन भारत के मुस्लिम समुदाय के लिए स्वीकार्य नहीं है। मुस्लिम अपने धार्मिक एवं कार्मिक मामलों में शरीयत का पालन करने में बंधे हुए हैं।
हमारी ताकत हमारी सांस्कृतिक विविधता है, और एक पूर्वनिर्धारित तरीके से हमारे धर्म का पालन करने के हमारे मौलिक अधिकार है।
हम एक सच्चे मुसलमान, एक सच्चे भारतीय और एक जिम्मेदार इंसान, बहुत अच्छी तरह से समझते हैं कि मुस्लिम पुरुष या महिला जो शरीयत का पालन में बंधे हुए हैं, उन्हें हमेशा न्याय मिलता है, लोगों को शरीयत के बारे में पूरी तरह से पता होना चाहिए।
विशेष रूप से विवाह, तलाक, विरासत, गोद लेने, रखरखाव आदि के बारे में मुस्लिम शरीयत सबसे व्यावहारिक हैं और महिलाओं के अधिकारों के संरक्षण पर केंद्रित। केवल कुछ ही लोगों को एक गलत धारणा है, उन्हें शरीयत के बारे में पूरी जानकारी नहीं है।
मेरे परिवार के सदस्यों, दोस्तों, रिश्तेदारों, पड़ोस के मुस्लिम महिलाओं में से कोई भी समान नागरिक संहिता के पक्ष में नहीं हैं। इन सभी महिलाओं को बहुत खुशी से शरीयत कानून और ऑल इंडिया मुस्लिम पर्सनल लॉ बोर्ड से संतुष्ट हैं।
इस तथ्य को सभी मुस्लिम संगठनों जो मौलिक रूप से अलग अलग विचार धारा के हैं द्वारा प्रदर्शित एकता से समझा जा सकता है। सभी ने सर्वसम्मति से शरीयत कानून में किसी भी परिवर्तन का विरोध किया, और पूरी तरह से समान नागरिक संहिता के खिलाफ है।
सभी मुस्लिम संगठनों प्रश्नावली विधि आयोग और आशय द्वारा तैयार खारिज कर दिया है, यह भी स्पष्ट रूप से व्यक्त की है कि समान नागरिक संहिता मुस्लिम समुदाय के लिए अस्वीकार्य है।
एक ईमानदार अपील भारतीय विधि आयोग को सभी मुस्लिम संगठनों द्वारा शरीयत के व्यक्तिगत कानूनों के बारे में हस्तक्षेप नहीं करने के लिए दायर की गई।
समुदाय का मानना है कि प्रश्नावली सिर्फ मुस्लिम पर्सनल लॉ खत्म करने के लिए कानून आयोग की पहल है। संविधान के अनुच्छेद 44 का हवाला देते हुए, एक प्रयास समान नागरिक संहिता को एक संवैधानिक स्थिति देने के लिए बनाया गया है। यह गलत है। क्योंकि खंड एक निर्देशक सिद्धांत है, और लागू करने के लिए बाध्य नहीं है।\
तो जहाँ तक संविधान का सवाल है, बुनियादी महत्व मौलिक अधिकारों के लिए है। प्रति मौलिक अधिकारों के अनुच्छेद 25 के रूप में, प्रत्येक और हर व्यक्ति को पसंदीदा धर्म का पालन करने के लिए उसका भ्यास और धर्म के प्रचार का अधिकार है।
श्रद्धेय अदालतों ने समय समय पर इस तथ्य को सही ठहराया कि मौलिक अधिकार सर्वोपरी हैं। अधआधिकारिक निर्देश के सिद्धांतों को लागू करने के बारे में वास्तव में चिंता अगर हैं तो प्राइम फोकस निर्देशक सिद्धांतों कि सीधे भलाई, कुल शराब निषेध, सभी बच्चों के लिए सार्वभौमिक शिक्षा, एवम स्वास्थ्य के प्रावधान ,जनता के कल्याण के साथ जुडे निर्देश , सभी के लिए सुविधाएं, सभी घरों में शौचालयों आदि इस तरह के लेख को लागू करने पर होना चाहिए।
किसी भी प्रावधान से जो देश की प्रगति और विकास के लिए आवश्यक हैं। कोई भी भारतीय मुसलमान या अन्य धर्म के किसी भी भारतीय को आपत्ति नहीं है।
यह एक झूठा भ्रम है कि समान नागरिक संहिता राष्ट्रीय एकता लाएगा। समान नागरिक संहिता लगाने से एकीकरण के बजाय, एकता का अभाव पैदा होगा और विघटन आमंत्रित होगा । क्योंकि भारत की सबसे बड़ी ताकत और सांस्कृतिक विविधता संबंधित धर्म के अनुयायी द्वारा धार्मिक और सांस्कृतिक व्यक्तिगत कानूनों का पालन करने की स्वतंत्रता है। यूसीसी से अल्पसंख्यकों के मन में अभाव की भावना पैदा होगी। जो देश के लिए हानिकारक होगा।
देश के लोग विभिन्न धर्मों का पालन करते हैं - हिंदू, मुस्लिम, ईसाई, बौद्ध, सिख आदि ने संयुक्त रूप से स्वतंत्रता के लिए लड़ाई लड़ी और अंग्रेजों के चंगुल से देश को मुक्त कराया।
भारतीय संविधान भी विविधता में एकता की नींव पर तैयार किया गया है। विभिन्न धर्मों और विश्वासों के बाद लोगों स्वतंत्र रूप से प्रगति की तरफ एक समाज की रूप में संयुक्त राष्ट्र और देश की सुरक्षा के लिए एक साथ इस विविधता और मतभेदों को रखते हुए भी सामाजिक जीवन में भाग लेते हैं।
भारत विभिन्न धर्मों, संस्कृतियों और बोलियों का देश है। कई आदिवासी समूहों को मुख्यधारा में लाया जाता है, जिनके साथ समझौते और आश्वासन किए गए थे कि कोई हस्तक्षेप उनकी सांस्कृतिक पहचान में नहीं किया जाएगा और वह वह सुरक्षित हो जाएगा। जबरन समान नागरिक अभ्यास के लिए कदम उठाना जो सभी को अपने धर्म का पालन करने की स्वतंत्रता के किये किये गए वादे के खिलाफ होगा जो एक बड़ा अन्याय होगा।
भारत विविध संस्कृतियों और विभिन्न धर्मों का राष्ट्र है। सभी समूह निजी कानून उनके धार्मिक ग्रंथों या शास्त्रों से प्राप्त कर रहे हैं ,और यह उनकी सांस्कृतिक पहचान में अद्वितीय प्रासंगिकता है।
इसलिए इस मामले में हस्तक्षेप करना किसी भी तरह से न केवल संविधान में निहित धार्मिक स्वतंत्रता का उल्लंघन है, बल्कि हमारी अद्वितीय सांस्कृतिक पहचान को समाप्त कर देना है। जो हमे किसी भी शर्त या क़ीमत पर मंज़ूर नहीं हो सकता।
विधि आयोग की प्रश्नावली पहल से एक राष्ट्रीय स्तर की चर्चा को प्रज्वलित करने से जो एक धारणा बन रही है कि निजी कानून सामाजिक असमानताओं और लिंग असमानता के लिए जिम्मेदार हैं और इसमे महिलाओं के अधिकारों को कोई महत्व नहीं है।
बहस के मुख्य विषय से कुछ एक विशेष धार्मिक समूह और उनके पर्सनल लॉ को निशाना बनाने के लिए तैयार किए जा रहा है। ट्रिपल तलाक, बहुविवाह, तलाकशुदा के रखरखाव के मुद्दे आदि पर पहल या विचार विमर्श से इस तरह तरह लग रहा है के केन्द्र सरकार द्वारा हलफनामे के इरादे समान नागरिक संहिता के लिए रास्ता साफ करने का उद्देश्य है।
धर्म केंद्रित संवेदनशील मामलों में कोई हस्तक्षेप सांप्रदायिक सद्भाव और सामाजिक ताने-बाने को बाधित करता है है । आज भारत को को निश्चित रूप से कई बेहतर प्राथमिकताओं यानी बेरोजगारी, बाल श्रम, गरीबी, अपराध नियंत्रण, स्वास्थ्य, साक्षरता, बलात्कार , सांप्रदायिक सौहार्द आदि पर बहस और कार्यान्वयन के लिए फोकस करने आवश्यकता है ताकि भारत की प्रगति हो और जल्द ही एक विकसित देश बन सके ।
इस याचिका के माध्यम से सब शांति प्रिय ,न्याय प्रेमी , देशप्रेमी लोगों से एक अपील की जाती है की समान नागरिक संहिता कदम का विरोध प्रदर्शन दर्ज करवाए।
इस याचिका के देश के माध्यम से सभी धर्मनिरपेक्ष राजनीतिक दलों से , निष्पक्ष ईमानदार ईमानदार मीडिया (इलेक्ट्रॉनिक, प्रिंट और सामाजिक) से भी एक अपील कि यूसीसी कदम का इतना विरोध करे के इस प्रयास से यह यह कदम कदम वापस लिए जाने जाने को मजबूर हो जाए.

मुस्लिम शरीयत से एक भी शब्द नहीं बदला जा सकता। मुस्लिम निजी कानूनों में कोई हस्तक्षेप की अनुमति नहीं है, मुस्लिम शरीयत निजी कानून कुरान और हदीस से लिए गये है और जरूरी है, और मनुष्य की आकांक्षाओं के साथ एक सुर में कर रहे हैं। हमे एक मजबूत दृढ़ विश्वास है कि विधि आयोग पूरी पूरी शरीयत समझ कर चलेगा तो पाएगा कि महिलाओं के अधिकार के संरक्षण के लिए कितनी गुंजाइश है, और और देखेगा की कि शरीयत निजी कानूनों के आधार पर बहुत मजबूती से वंचितों, कमजोरो , महिलाओं और बच्चों के पक्ष में अधिक है।
ऑल इंडिया मुस्लिम पर्सनल लॉ बोर्ड (एआईएमपीएलबी) कानूनी तौर पर भारत सरकार के विधि आयोग में और सभी प्लेटफार्मों पर पर जहां समभवतः प्रतिनिधित्व किया जाना चाहिए मुस्लिम समुदाय की सच्ची भावनाओ का प्रतिनिधित्व कर रहे हैं। और उनको हमारे मजबूत समर्थन की आवश्यकता है।
