The Issue
The Nisga’a people who have signed this petition believe that Nisga’a Lisims Government Administration including In-House Legal Counsel are not acting in accordance with Chapter 4 – Government of the Nisga’a Nation section 23, sub sections (a), (b), (c) and (d) of the Nisga’a Constitution.
Sections cited from the Nisga’a Constitution:
Section 32. Authority of Wilp Si’ayuukhl Nisga’a (1) Wilp Si’ayuukhl Nisga’a may exercise any right, power or privilege, and may carry out any duty, function or obligation, of the Nisga’a Nation or Nisga’a Lisims Government set out in the Nisga’a Treaty, in accordance with Nisga’a law.
Based on video release from the former IT Manager for Nisga’a Lisims Government who publicly disclosed that Nisga’a Lisims Government took him to court to seal the affidavits pertaining to the email he released in May 2019 and that the first court case brought against him by Nisga’a Lisims Government was denied and that Nisga’a Lisims Government appealed the decision and lost again and that Nisga’a Lisims Government is in the Midst of appealing to the BC Supreme Court.
This court case shows us the process of the investigation was flawed. In fact Nisga’a Lisims Government did a Media Release making reference to “No Merit to Allegations” then in the last two paragraphs stated that the investigation did provide recommendations for changes in Nisga’a Lisims Government Administration processes.
By our signatures below we demand the following:
n WSN request a breakdown of all costs associated to the Cardinal case
n A full unredacted Phillips report be provided to WSN regarding the Special Investigation
n Who authorized the court cases to continue after the first case was lost.
n Review of Conflict of Interest guidelines when Elected Officials are appointed to Special Committees.
n Established timelines for any Committees of Nisga’a Lisims Government when dealing with serious matters.
n A review on the actual allegations identified in the May 2019 email.
As financial irregularities were identified in the email released by the former IT Manager of Nisga’a Lisims Government we demand the following:
n A Forensic Audit/Investigation on all Financial allegations referred to
n Due to the seriousness of the incomplete Special Investigation report we are recommending that the Nisga’a Elections be postponed for one year.
n We demand that a timeline 9 months be provided to WSN to complete a new report.
n That any employees named in the email be placed on Administrative Leave until such report is complete.
In accordance with section 32 Authority of Wilp Si’ayuukhl Nisga’a. WSN has the authority to:
n Request for all Impact Benefit Agreements since the year 2000
n Request for a breakdown of all costs associated to the Special Investigation report.
n Request Legislative reviews of any Laws or Acts of Nisga’a Lisims Government
n Request for Request For Proposals for Consultants, Legal Counsel and Auditors which should be done every 5 years.
n Request Legal Cost paid by Nisga’a Lisims Government from the year 2000 to current.
n Request that in the event Administrative Leaves are required, WSN has the authority to appoint an acting CEO, who will report directly to WSN.
