Amid fears that children and adults with autism and/or learning disabilities would have no access to life saving treatment for Corona Virus, NICE issued guidance clarifying that they would have access to treatment.

However, it IS clear that rationing of ventilators is occurring, and according to Imperial College Healthcare Trust, this is being done on medical grounds, and not  on grounds of capacity.

Whilst EActNowUK are relieved to hear that for some disabled people, reassurances have been given, many disabled charities and advocates are still seriously concerned: EActNowUK co-founder Jaki Whyte has called this "nothing short of state sanctioned murder" and has bluntly used the word "genocide".

The Equality Act 2010 is clear: if a policy, practice or procedure puts disabled people at substantial risk in relation to an able bodied person then it is discrimination - it does not matter what type of disability it is.

Death is a substantial disadvantage in relation to an able bodied person, and we want ALL responsible Ministers and NICE to immediately confirm that every single disabled person will not be subject to rationing on the basis of any disability, if they contract Corona Virus, and to do that immediately.

This policy WOULD breach 7 points of the Human Rights Act:

1: Article 2, Right to Life

2. Article 3, Freedom from torture, and inhuman or degrading treatment

3. Article 7, No punishment without law

4. Article 8, Respect for private and family life, home and correspondence

5. Article 14, Protected from discrimination in respect of these rights and freedoms

6. Protocol 13, Article 1, abolition of the death penalty

7. Article 13, if peoples rights are violated they are able to access effective remedy,  this means they can take case to court to seek a judgement
