Shaquill Battle was arrested with a crime that he did not commit or nor was he involved in any manner, stemming from a statement from his co-defendant.  During the dun away hearing, the statement was on a disk, but not confronted. During trial, the court allowed the co-defendant to plea the 5th amendment without cross examination through out the entire proceedings.  Shaquill conducted the proceedings, jury selection through sentencing.

During the trial, the court failed to charge the jury on the elements of robbery, what a robbery is or what degree the robbery was.

SIx and half years has elapsed and the trial judge now presides over the appellate court where the appeal was decided on Dec. 23, 2021.

The court ignored the issue of due process and six amendment rights by not addressing the issue of the charge conference, the victim girlfriend told the police how the damage happen, but now she disappeared.  

How can a defendant be prosecuted at the most highest court and be deprived of confronting his accuser, who pleaded guilty during the indictment?
