Remove Judge Crnkovich and restore Justice

She puts children, parents and attorneys in handcuffs. She is one of Nebraska’s lowest rated Judges (since 2006). She is well known in Douglas County for her abrasive demeanor and foul temperament. Her Courtroom has been described as a “Hellhole” by a State Senator and Nebraskans pay her almost $1,000,000.00 per six year term. It is time to remove this BAD JUDGE.

Gov. Pete Ricketts Inaugural Address January 8, 2015.

Honorable Michael G. Heavican

Attorney General Mr. Doug Peterson

Dear Gentleman:
$922,183.32, this is the dollar amount a District Court Judge or a Juvenile Court Judge will be paid as a minimum during a six year term on the bench (Nebraska Revised Statute 24-201.01, 24-301.01). Many Judges will serve several terms by retention votes but this amount for only one term is more than many Nebraskans will earn in their adult lifetime. Hardworking Nebraskans, people that set the standards and characteristics of a “Midwest work ethic”. So when we hear statements like “The people of Nebraska expect Government to work”, it goes without saying. We do expect Government to work, at all levels.
Yet, there is one Judge, a Douglas County Juvenile Court Judge, Elizabeth G. Crnkovich that when held to the standards of a Midwest work ethic and when compared to the performance of almost every other Judge in the State, fails to meet the expectations of her peers and the citizens of Nebraska. Let me explain that further.
Every two years the Nebraska State Bar Association (NSBA) conducts a judicial evaluation survey. In a letter to fellow Nebraskans date July 13, 2012, regarding the survey, the President of the NSBA writes; “The Nebraska State Bar Association is committed to doing all it can to assure that the citizens of Nebraska have a justice system that is fair, impartial, honest and effective. Towards this end, the Nebraska Bar Association every two years asks its member lawyers to evaluate the performance of the judges that serve our justice system.”

The NSBA Judicial Evaluations for the years 2014, 2012, 2010, 2008 and 2006 show that (when attorneys rated Judge Elizabeth G. Crnkovich) more than half of the attorneys answered “No” to the question on the surveys; In your opinion, should this judge be retained in office? Regarding Judge Crnkovich:

• 56.4% answered “No” in 2014
• 56.6% answered “No” in 2012,
• 62.7% answered “No” in 2010,
• 57.6% answered “No” in 2008
• 52.0% answered “No” in 2006

Nearly one million taxpayer dollars paid to a Judge that for the past five state bar evaluations has failed to muster the confidence of even half of the attorneys completing the survey and defending our children in front of her. This for a Judge that was rated a “1.98” (Very Poor) in “Judicial Temperament & Demeanor”, a Judge that was rated as “Deficient” in 9 out of 11 characteristics evaluated, a Judge that had no “Good” or “Excellent” marks and the 2 of the 11 marks not “Deficient” were merely “Satisfactory” (2014 Survey).
Where is the effort to “safeguard the public trust” in these dismal reviews? This level of job performance would never be tolerated in the private sector and it should not be tolerated in Government. As the Governor states, “they hold us to high standards”.
Therefore, we the undersigned ( petition the Governor to ask for the immediate resignation of Douglas County Juvenile Court Judge Elizabeth G. Crnkovich. We petition Chief Justice Heavican to encourage Judge Crnkovich to tender such resignation. And, we petition Attorney General Doug Peterson to issue a public statement offering an opinion regarding whether or not he believes the poor judicial performance as evidenced by the evaluations from the NSBA from the year 2006 to 2014 on Judge Elizabeth G. Crnkovich hinder in any capacity the fair, impartial, honest and effective administration of justice in her courtroom.
“Equality before the Law” wanes with diminished confidence in the judiciary.
