The Issue
Dear North Carolina Representatives and Senators,
We the citizens of North Carolina ask that you support House Bill 954: Terminate Agreement for Tolling of I-77. Since its filing date of 04/19/16, HB954 has garnered the bipartisan support of 27 representatives from across our fine state, whom understand and respect the request of the citizens.
“GENERAL ASSEMBLY OF NORTH CAROLINA SESSION 2015 H D HOUSE BILL DRH40545-MLa-260A (04/19) Short Title: Terminate Agreement for Tolling of I-77. (Public) Sponsors: Representatives Jeter, Hager, and Bradford (Primary Sponsors). Referred to: *DRH40545-MLa-260A* 1 A BILL TO BE ENTITLED 2 AN ACT DIRECTING THE DEPARTMENT OF TRANSPORTATION TO TERMINATE THE 3 COMPREHENSIVE AGREEMENT FOR THE I-77 HOT LANES PROJECT IN 4 MECKLENBURG AND IREDELL COUNTIES. 5 The General Assembly of North Carolina enacts: 6 SECTION 1. Termination. – In a manner consistent with the terms of the 7 Comprehensive Agreement, the Department of Transportation shall terminate the Comprehensive 8 Agreement for the I-77 HOT Lanes project in Mecklenburg and Iredell Counties. Nothing in this 9 section shall be construed as relieving the State from paying damages determined to be owed from 10 the early termination of the Comprehensive Agreement. For purposes of this act, "Comprehensive 11 Agreement" means the Comprehensive Agreement dated as of June 26, 2014, including any 12 amendments made to the Comprehensive Agreement as of the effective date of this act. 13 SECTION 2. Appropriation. – There is appropriated from the Highway Fund to the 14 Department of Transportation the sum of twenty-five thousand dollars ($25,000) in nonrecurring 15 funds for the 2016-2017 fiscal year to be used for any legal fees incurred in determining the 16 amount of damages that may be owed and other effects resulting from cancellation of the 17 Comprehensive Agreement in accordance with Section 1 of this act. 18 SECTION 3. Effective Date. – Section 1 of this act becomes effective September 1, 19 2016. The remainder of this act becomes effective July 1, 2016. H.B 954 Apr 25, 2016 HOUSE PRINCIPAL CLERK.”
