National inquiry against corrupt social services and local authorities

The Issue

The current law vigorously protects social workers that are often guilty of corruption.

Parents and defence lawyers have very little field to play in as unfortunately often judges take the word of social workers as factual and professional. We know that often they fabricate lies or narrate a picture of events that best suites them to justify removal of children. Unfortunately parents have very little way of showing the court's that they are indeed lieing or that their 'misconceptions' are non factual.

The uk juridical system is an adversarial one, even with matters that are delt with in family law, meaning its not up to the judge to find evidence of an alleged 'liability' or culpability its up to the parties to present their cases. The current situation is that, because of a loophole in the system, that favours the words of professionals over the words of families. This is a great miscarriage of justice as it prevents absoulte clarity and harms a just outcome in the sake of justice for all parties envolved. Expecially if one of them is accused then liable of malpractice. Also the current system that relies on 'the balance of probabilities' being a matter of civil law, if we follow the same thought process that we followed above, this is detrimental to parents whom have no way, the way things are right now to demonstrate a case of malpractice, expecially when police are refusing to investigate. In some instances children are taken away over an alleged potential of harm and neglect. Do you realise that they are taking away kids over a potential of an offence that someone could potentially do. Not over an actual crime that has been committed. During court proceedings, bearing in mind that a decision by the judge has not yet been made, parents are unfairly treated like criminals, in cases of malpractice again a massive miscarriage of justice.

FURTHERMORE the current civil law Court system, as such also family law, revolves around a philosophy motivated by monetized functioning. Reason for which I will ask in following point 29 for all crimes of corruption to be a matter therefore of criminal law.

 

Let's try our best to try and ensure that social workers are not above the law and face the music for their wrongful actions.

What we call for:

  1. A NATIONAL INQUIRY led by the government in to local authorities procedures in regards to allegations of human trafficking. Taking children away for illicit or reasons that appear to be menial.
  2. If for instance a social worker is guilty of malpractice. An amendment to a new law that gives the perpetrator a sentence similar to those conduct crimes of human trafficking.
  3. A creation of a private or government organisation external to the grounds of the local authority that rules and regulates the operations of social services that can prevent them from perpetrating crimes of malpractice, prevent inadequate training of social workers. Like the media has osfed we want something similar that can regulate social services.
  4. A law that can protect the police from serving as pawns of the local authority. In the event of malpractice on behalf of a social services.
  5. An updated assessment method that social workers use to assess a parents capability. As the current one seems almost absurd.
  6. Facilitate and make mandatory police investigation where allegations of malpractice are made.
  7. More clarity on who regulates social services so people can make complaints. For instance at the current time when court cases are taking place its not possible to raise a complaint against them. This surely can't be legal or fair. Change this so the whole process is fair to all.
  8. Termination of the contempt of court law for families. Why are attempting to silence people? It's absured. This collides with people's personal freedom of speech.
  9. Ensure social workers have to wear cameras on duty for their own safety and recordings to be used in proceedings when of relevance.
  10. Make it mandatory for an indipendent social worker E.g. that works for the courts. That dosen't work for the social workers on the case to assess parents capabilities unbiased to social workers judgments. In all cases that are brought to the courts.
  11. Mandatory for an indipendent party to supervise all 'contact' (as they call them) sessions who works for the courts like a specialised social worker to prevent malpractice and relying on a 'my word against yours' procedure that quite frankly doesn't benefit neither parents nor social workers.
  12. We want a clear law against social workers malpractice, where when proven guilty of essentially human trafficking, they get criminally charged with severe sentencing. In other jobs, you make a mistake and are found liable or can be criminally prosecuted. Why shouldn't this apply to them to? Are they above the law?
  13. Make legal aid available for parents who accuse s.workers of malpractice.
  14. Stop forced adoption. Every case must be individually assessed.
  15. Make malpractice vs the law with a proper law and even if crime was committed 30 years ago to make cases be reopened by courts on a mandatory basis.
  16. End 'meeting adoption targets' and bonuses that go to the local authority. Adoption should be a last resort not a competition to make money. End government funding for this.
  17. Make it a crime for social workers to stalk parents social media. Ripa act 2000 to be applied.
  18. Make it a crime if people are falsely referring a family to social services.
  19. Indipendent social workers and psychiatrist to make decisions on unbiased information and as a clean slate rather than going on prior information. Why? Becuase if a lie is on paperwork at the current time it gets carried on and perpetrated from professional to professional. And if they go on prior information it defiles its purpose of having an indipendent assessment.
  20. When there's demonstretable accounts of perjury when they have lied on both paperwork and to judge. And if this has led to removal of children. We ask for a minimum sentence of 5-10 years for lieing on paperwork.
  21. Make it illegal to remove chidren on a potential of harm and neglect. This only to happen if major harm or neglect has happened in the past.
  22. Make it illegal for police to carry out the local authorities dirty deeds if they are getting accused and parents have evidence of harassment.
  23. A crime if social services deliberately attempt to sabotage parents and court hearings. Ex. Sending in paperwork day before hearing at 530 so parents can't dispute it in court.
  24. Make it illegal for social workers to lie about level of support given to families. Easy to sit there and critique more difficult to make parents aware of courses they can attend to better their parenting skills and provide high level of support.
  25. Make medical records accessible to social workers of parents only if there is a genuine documented concern of potential harm to children. Physical or emotional. They don need know who I dated 20 years ago for example. Irrelevant.
  26. Illegal also to base parents capabilities on assumptions of what they can or can't do. Rely on facts. As could be extremely discriminatory.
  27. Social workers found guilty of malpractice aka corruption to be banned from the profession, and not able to work with children or vulnerable again.
  28. DECISION making with regards to the placement of children following court procedures needs to happen in court room by judge, not to happen in private rooms,  prior to court proceedings as in accordance, in abidance to the upholment of current laws acting with clarity, with an aptitude relevant, motivated, justifiable, in pursuit of moral integrity standards and not with criminal mindest that in conclusion as such could lead to a widespread dissemination of dissatisfaction within the expectations of the citizenry in what the law should uphold to and be.
  29. All cases of corruption, to be a matter of criminal law.

In the event of social workers, deliberately pursing a determined outcome, rigging events in their favour by deliberately commiting perjury and lieing on paperwork with malicious intentions, With the sole main purpose of making money on a families heads, if the outcome of removal of children could of been otherwise preventable and unnecessary, if therefore an instance or several of corruption is then demonstrable beyond all benefit of doubt. A degree of more serious sentencing is required.
