

I sent out the following email to our Town Solicitor in reference to the letter that was generated by the Town of Narragansett's Town Solicitor James Callaghan regarding the noncompliance zoning parking lot lease RIDEM Granted to Procaccianti -Paolino in Galilee, RI. While I appreciate the letter being sent out to the State Properties Committee, the RIDEM, and Procaccianti Developers, I feel it needs to add a cease and desist order as the RIDEM has continued to allow Procaccianti - Paolino still operate a parking lot in Galilee throughout this summer even though a Special Use Permit is required by the Town of Narragansett.
Dear Honorable Town Solicitor James Callaghan,
I appreciate the letter you wrote to the State Properties Committee and that you sent to the RIDEM and the Rhode Island Attorney's Office. (Your letter is attached to this email). As it is obvious PRI X ( Procaccianti - Paolino) are operating a parking lot on the State Lease Land by the RIDEM and they are out of compliance with respect to the Town of Narragansett's Zoning Ordinance, the Town needs to take action the will stop the use of the continued parking lot. As the parking lot has been fully operational this summer, I feel the Narragansett Town Council needs to issue a cease and desist letter and send it out certified to the RIDEM and PRIX. I would recommend sending a registered letter and forwarded to the State Properties Committee, the Rhode Island Attorney General's Office, PRIX (Procaccianti - Paolino), and the Governor's Office. I would also notify all of the television stations and media of the cease and desist order issued by the Town of Narragansett when the Motion would be heard by the Narragansett Town Council for approval. Therefore, if the Motion will be placed on the agenda for the Narragansett Town Council Meeting, we can invite the news stations to cover the meeting when the motion would be heard. Time is of the essence as it is the primary season. With our Governor failing to take action, and the Town of Narragansett issuing a cease and desist order, it should surely make the news as it is a rarity that a Town or City files a cease and desist action to a State Agency and its lessee.
I do have a recommendation to readdress a section of the letter sent out as it notes below,
In addition, in the event that new or revised parking lots. I am puzzled by that opening statement as PRIX is operating parking lots now. I would reword the sentence as follows. Based on non compliance of the existing parking lots on Parcels 256 and 257, the Town of Narragansett is issuing you a cease and desist order as the property in zoned GB - Galilee Business, and a special use permit on the lots has not been granted by the Town of Narragansett. I would also impose significant fines per day the parking lot remains in operation. Let PRIX pay for their non-compliance. As recently as today, the RI Attorney General's Office noted it will fine homeowners $5000 per day for those who are violating the state law of having lead paint in the house. I would therefore, send out a followup letter as the letter you sent out is not binding to impose any fines or consequences to the RIDEM or PRIX for openly violating the Town of Narragansett's Zoning Ordinance. :
The below paragraph has been copied for your reference that I feel needs to be reworded as it does not show any consequence for the RIDEM and for PRIX operating their existing parking lot,
In addition , in the event that new or revised parking lots, or any other development projects are: under consideration, please be advised that any commercial off street parking in the GB zone requires a special use permit pursuant to Section 4.8.2ofthe Ordinances of the Town of 3 Narragansett. Further, the Town ordinances contain specific design standards for parking lots in the PortofGalilee Special District (Section 4.8.2 (F) (3): (®) Parking lots that front public streets shall be screened by landscaping or with walls or fencing a minimum of three feet in height. Walls and fences shall be of a scale and material appropriate to the ste and surrounding area (h) The interior of all paved parking areas within the Galilee business zone shall be enhanced with planted islands, with a minimum of one island for each 20 parking spaces. The planted islands shall be placed so as to prevent long rows of uninterrupted parking spaces and be designed to assist in treatment of stormwater runoff. All islands are surrounded by continuous raised curbing.
