Who is considered a “mobile food unit”?
My credibility: I am a US Army veteran, and current governmental auditor. Obtained my BS in Accountancy from UK and Masters of Accountancy from UofL. I am a subject matter expert in the dealings of governmental regulations and who they effect. What is “in scope” of the regulation means “who it applies to”.
The Mt. Washington Food Truck ordinance has defined what a “mobile food unit” is. We would assume that this is your typical food truck that cruises the street. According to the ordinance, any “mobile” vender falls within scope of the food truck ordinance. This means that if your edible goods are NOT sold from within a four wall building, you’re a lumped into one definition as a “mobile food unit”. If your food (or equipment used to make the food) is transported to a site by means of a vehicle, you are a mobile food vender.
Here are some examples:
- Vender’s who sell goods at the Farmer’s market. (Excluding agricultural goods, as they are protected by State Law.)
- Vender’s who support the Spring and Winter city festivals.
- Church Fish Fry’s.
- Any food delivery (Schawn’s, Pizza Hut, Grub Hub).
Ultimately, all the above circumstances fall within scope of the exemption I am fighting to protect. (More info in the previous updates.) City Council is proposing to remove this exemption and will force all the above situations to purchase a $250 annual permit.
All these errors and overlooks are a direct result from a lack of due diligence within City Councils proposition. It’s a hastily proposed amendment, that is purely to discriminate and influence the economy. The picture attached contains the exact definitions within the ordinance and how all venders are being lumped into one classification. If you’re interested, look up Louisville’s definitions and see how they correctly have differentiate stationary venders, mobile venders and food trucks.
