Review and change the Body Corporate & Community Management Act to protect consumers from unfair contracts and corrupt practices of Building Caretakers and management right companies.
The issue
There are millions of units in Australia and 440,000 units in Queensland alone - many that are subject to corrupt practices of the management rights industry. Unfair contracts have been forced on to bodies corporate at huge prices in perpetuity by greedy developers AND past committees who have not acted in the body corporate's best interests. 25 year contracts given for free to Caretakers with their on-going extensions should be banned to allow unit owners to get rid of non-performing Caretakers which is almost impossible under the current legislation. Elderly people live in fear and are abused with stand over tactics by bullying Caretakers. Body Corporate levies are way over what they should be due to these unfair contracts and depress the value of units and investment. Caretakers sue owners when they dare complain about their lack of performance and tie them up in a Tribunal that doesn't follow its own rules making justice expensive and almost non-existent. The Office of Fair Trading has taken 4 years to act on complaints to do with undisclosed commissions! Many unit owners have to sell up to get out of the corruption at huge personal cost. The reason I am seeking your support is I have been fighting for 5 years for justice in my building. The previous government had started a review of the legislation and consulted with industry groups such as Unit Owners Association of Queensland (UOAQ). This Government has done nothing. Minister, please meet with consumer groups such as the UOAQ and urgently review this draconian legislation to protect consumers rights.
