Mother seeking Justice for her Daughter

The Issue

This is important because the justice system has failed my family. On April 6,2012, My daughter La Shae' Tolbert was found guilty of two counts of aggravated assault and  conspiracy. On June 06, 2012, La Shae' Tolbert was sentenced to forty eight to nintey six months in a state prison. I would like to change the present status of my daughters situation.I  would like to see her charges dismissed, lessened or at least given a new trial. La Shae Tolbert is innocent she played no part in throwing scalding hot water on Tony Booth or Nia Booth .The only thing she is guilty of is being there for her sister. Tony Booth and her sister Nia Booth had been bullying my oldest daughter Asia Wannamaker for at least two years prior to this incident.There were various complaints  filed over the course of two to three years. There were  supporting documents; which for some reason were not brought in as evidence. Tony Booth and my daughter (Asia) were very good friends at one time. However at some point they had a disagreement and ever since they have been bumping heads.The city police have come on more than one occassion due to problems between Asia and Tony. La Shae' and Tony had an incident were Tony wanted to fight La Shae but she was pregnant, thier fued has been never ending and I have no clue as to why.The police were called for that incident.

I am in no way trying to defend my daughter Asia Wannamakers actions however I do feel that it was provoked. Asia called her sister and her mother because she was afraid for herself and the two children, her daughter Tylazia 11yrs. old and her niece Malacha 6 months. It is my understanding that she threw water on Tony Booth the first time in the stairwell of thier apartment complex. she then went into her home while there were four to six people outside her residence taunting her to come fight. La Shae' arrived to pick up the girls and noticed water in the stairwell knowing that her mother was to arrive shortly she began cleaning up the water because her mother had just had surgery (total knee reconstruction) and it would be dangerous for her with a wet floor and steps.

Shortly there after her mother arrived. Asia was on the phone with the city police and La Shae began to explain what happened. Once I heard the details of the situation I advised Asia that we should go downstairs and wait for the police to arrive. La Shae' was taking the children home but once proceeded downstairs to the bottom of the stairwell I (mom) opened the door to the outside and a car pulled up and this woman (Nia Booth) jumped out of the car and said' "Which one of you bitches is Asia ?" Asia said; "I am Asia" that is when Nia Booth proceeded to punch Asia in the face and they began fighting and fell to the ground fighting. I am unsure of the time that elapsed but it was not long and the police had arrived and broke up the fight. They immediately place Nia Booth in the ambulance and Tony Booth began screaming on the second floor of the stairwell and kicked out the window.

The police arrested Asia and La Shae'. At that time we repeatedly asked why La Shae was being detained and we recieved no response from the officers. At that time I (mom) took the children and went to my mothers house. After a bit Asia and La Shae called; La Shae' informed me that she too had been charged for throwing scalding water on Tony and Nia Booth. Asia gave her statement letting the authorities know that she was the only person who threw the water and that La Shae had only come to get the children.

The following day they were released from Dauphin County Prison with Pre-trial. La Shae' was charged with two counts of aggravated assault and conspiracy. La Shae' was upset because she could not understand why she was being charged when she had done nothing. So we proceeded with the court process and La Shae' claimed her innocence not letting up. she decided to take a jury trial because we were sure that once they saw and heard the evidence that the charges would be dropped for sure.

On June 6, 2012 a jury found La Shae guilty of two counts of aggravated assault and conspiracy. The jury says that while Asia had Nia Booth on the groung fighting after throwing scalding water in her face La Shae proceeded back up the stairs boiled another cup of water came downstairs and threw it on Nia while Asia was on top of her fighting. Is that even a possibility? How is it that Asia did not get burned and she was on top of her? How come they only had one cup at the scene?

I was under the impression that a jury deliberates and looks through all the evidence and if everything is beyond the shadow of a doubt then guilt is found.I feel that La Shae deserves a new trial because her lawyer(Wendy Gruellas)   representation was not a hundred percent. We could not then nor can we now afford a paid attorney however I am making every effort to find one that may work with my family. La Shae has a beautiful two year old daughter and is presently pregnant. Ms. Gruellas efforts to help La Shae were minimal. La Shae deserves to be represented by someone who believes in her innocence and will give thier very best as an attorney.

I am in no way trying to dismiss my daughter Asia Wannamakers actions although she had been pushed to her breaking point that was not the right course of action.

La Shae was given four to eight years in a state prison, for a crime she did not commit.during the trial she asked her lawyer for a lie detector test to prove her innocence but Miss. Gruella never followed through and we later found out that lie detector tests are inadmissable in court. she really has no other way to prove her innocence except to rely on our justice system once again hoping this time she can get a fair trial.

Judge Jeannine Turgeon was very bias. she blamed and scolded La Shae for her parents past mistakes ,drug use and thier run ins with law.The mistakes her parents made had absolutely nothing to do with La Shae. If in fact they did it was positive. La Shae had some issues as a juvinile but because of those issues she got herself together. She has worked since she was fourteen.she graduated when she was sixteen, obtained her CNA certification and was on her second semester at HACC  to become a nurse when this incident occured.

La Shae has had her trials during her childhood. Her mother and father in and out of jail and on drugs. her father was murdered when she was twelve. He was burned to death in his vehichle. and she has never recieved any kind of counseling. I am not saying any of this to make excuses for her behavior but I feel that because she is not an emotional person the jury and the judge felt that she was hard. La Shae has a hudge heart. she has a two year old daughter that she cares for by herself and she is presently pregnant. she is and amazing mother, daughter, sister and freind. La Shae' is a little rough around the edges but she is a good person.

I am reaching out to the public world because we need support and help. My daughter is INNOCENT. I was there and I the truth but I need you to see the truth help me seek the truth and believe it. I am a mother of my word and if she was guilty then I would just deal with it and hope that they were lienient in sentencing her as they were with Asia. she recieved two and a half to five years for throwing scalding water on someone and La Shae gets four to eight years for being there. I am going to fight for my child because I know the truth and I refuse to sit back and let my daughter be railroaded for something I KNOW she did not do.

I am petitioning the media, goverment officials, attorneys, and communities around the world. Please help me fight for the justice of my daughter, La Shae' Tolbert.
