We, the undersigned residents of Mogale City Local Municipality, hereby petition the Member of the Executive Committee for Co-operative Governance and Traditional Affairs, e-Governance and Research and Development to uphold, defend and protect the Code of Conduct for Councillors. We are aware that our constitutional and democratic rights to representation have been violated, whereby 40 councillors missed council meetings without leave of absence on the 07th March 2023, 17th March 2023 and 20th March 2023.

Furthermore, the Code of Conduct for Councillors as contained the Municipal Structures Act No. 117 of 1998 as amended, in schedule 7, item 5(2) states: “(2) A councillor who is absent from three or more consecutive meetings of a municipal council, or from three or more consecutive meetings of a committee, which that councillor is required to attend in terms of item 4, MUST be removed from office as a councillor.” All the necessary evidence has been submitted, and in terms of section 17 of the Constitution of the Republic of South Africa, 1996, We the residents hereby petition and compel your good-self to enact your duties and remove those truant councillors as per the envisioned sanction contained in legislation, so as to ensure the protection of our constitutional and democratic rights to representation.
