Dear Supporters,
I want to thank the producers, artists, label owners, and music lovers who have engaged in discussions about the Transformative Sampling Act. Your feedback has helped me understand the perspectives from all sides, both the challenges producers face in legally clearing samples and the concerns that rights holders have about protecting their intellectual property.
The goal of this Act is not to eliminate traditional sample clearance. Instead, it proposes a structured, fair, and sustainable licensing system that ensures producers, artists, songwriters, and labels all benefit from the growing culture of transformative sampling.
Addressing Industry Concerns
Many have asked, ‘Why not just clear samples through existing systems?’ While platforms like Tracklib offer an affordable option, they have a limited catalog, restricting producers from sampling the records they truly want. Other clearance processes are often inconsistent, expensive, and inaccessible for independent creators.
The Transformative Sampling Act seeks to solve this by introducing a non-exclusive compulsory licensing system for transformative samples, ensuring:
✔️ Guaranteed payments to rights holders through an upfront licensing fee.
✔️ A clear, predictable structure that eliminates legal uncertainty for producers.
✔️ New revenue streams for catalog music, driving renewed interest in older records.
✔️ Direct payments to artists and songwriters, ensuring they benefit even if they don’t own their masters.
Proposed Licensing & Revenue Model
Rather than vague, case-by-case negotiations, this system would introduce transparent revenue splits that work for all parties:
• Artists & Songwriters: 40%
• Publishers: 20%
• Record Labels (Masters): 30%
• Admin Fees: 10%
Example Revenue Breakdown for 1M Streams:
✔️ Total Spotify Revenue: $3,000
✔️ Sampling Royalty Deduction: $1,000
✔️ Artist/Songwriter Share: $400
✔️ Label Share (Masters): $300
✔️ Producer’s Net Earnings: $1300
A Win-Win for Everyone
This Act does not replace traditional sample clearance; it offers an alternative for producers who want to use transformative samples without exclusivity. It ensures that:
✅… Labels and publishers continue to profit from their catalogs.
✅… Producers have an affordable way to legally sample music.
✅… Artists and songwriters get paid directly, rather than being overlooked in label-controlled deals.
We’re open to industry discussion and collaboration to refine this model. The goals are to help a new generation of creators innovate responsibly and to make sampling fair, transparent, and accessible for everyone.
