PIL AGAINST OPEN DRAINAGE IN PALAM VIHAR

The Issue

We at AKJ ATTORNEYS & SOLICITORS are filing a Public Interest Litigation before the Hon'ble Punjab & Haryana High Court, in the interest of Palam Vihar regarding the severe issue of "Open Storm Water Drain in Palam Vihar" and would like to  request the residents of Palam Vihar to sign the petition and support us in this endeavour. 

The storm water drain was broken open and dug by the workers/labourers of the Gurugram Metropolitan Development Authority (GMDA) in October, 2020, near F Block of Palam Vihar, Gurugram and it has been open ever since. Before the opening up of the said drain, no prior notice/ notification/forewarning was given to the residents of the area. The filthy and contaminated stagnant water in the said open drain has a bad odour, which makes it very uncomfortable and unsightly for the residents living nearby. This is a cause of great concern, especially with the families having children as they may play near the infected water and risk their health. The  open drain is bound to receive domestic wastewater together with storm water mixed with solid waste, clinical waste, silt, chemical waste and other contaminants that finally discharge into main water bodies such as streams, rivers, lakes and oceans, thus contaminating the water sources.

Stagnant water in poorly constructed open drains will also lead to contamination of groundwater, along with the breeding ground of disease-carrying vectors, especially mosquitoes, which are the source of adverse health risks such as the spread of malaria, typhoid, dengue fever, yellow fever chikungunya etc. The said open drain often gets clogged due to deposits of silt and other solid wastes thrown into it, especially during the incessantly heavy rainy season which is approaching Gurugram soon. The clogging will result in flooding that in turn will destroy the roads and will aid disease-causing germs and parasites to spread. 

We have already filed various complaints with the concerned department but till date no fruitful action has been taken, thus now we have decided to approach the Hon'ble High Court Of Punjab And Haryana to seek some redressal in this matter.
