David Eby / NDP Government took away our rights.
Injured human beings lives are being seriously affected by careless and dangerous drivers and the "Enhanced Care System"
Section 7 of the Canadian Charter if Rights and Freedoms guarantees our right to life, liberty and security of the person - protected by the principles of fundamental justice.
Removing the right to sue at-fault drivers and ICBC, without fair legal recourse, violates these principles by denying people access to justice and accountability. Everyone deserves the right to hold those responsible accountable.
The government's justification these changes save money for ICBC and provide drivers with better interest rates cannot override our fundamental rights.
People with pre-existing disability, medical or struggling are harmed twice: first by the negligent driver, and further punished by this system.
There's no compensation for pain or suffering, loss of dignity or affecting people's lives. This is cruel and dehumanizing to all those injured.
ICBC's framework is affecting the lives of innocent people injured, BC's medical system, proper compensation and supports.
Injured people are trapped in a system they can't opt out of. The government handed injured people - with no legal protection or independent legal support for them - directly to ICBC.
David Eby and the NDP are failing British Columbians injured or killed by at-fault drivers.
Most British Columbians aren't made aware until they themselves, a loved one, or someone they know are injured or killed by an at-fault driver,
There are no publicly funded legal aid or advocacy organizations who specialize or help in ICBC claims. The injured are left to further struggle on their own with no legal aid, support, advocacy or oversight over ICBC or the medical during the ICBC claims process.
Section 15: Equality rights: Guarantees that every individual in Canada has the right to equal protection and equal benefit of the law without discrimination.
The injured who can afford to pay a lawyer out of pocket are not covered by any government program nor reimbursed by ICBC.
Systematic unfairness built into the system to serve the corporation, not support the individual.
Yet, ICBC has professional teams, employs and contract lawyers and medical professionals and trained adjusters.
When someone is injured, especially by an at-fault driver, telling them, "just represent yourself" is cruelty by design.
The government created a form of systemic discrimination that punishes people for being injured, cognitively impaired, or traumatized.
This gap is not merely a policy shortcoming but a significant human rights concern.
The government was NOT transparent how damaging the ICBC No-Fault system really is.
It is NOT "Enhanced Care".
The only thing changing the laws enhanced was the government giving ICBC almost total control over injured human beings.
