MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 is a legislation enacted in 2007, initiated by the Ministry of Social Justice and Empowerment, Government of India. to provide more effective provision for maintenance and welfare of parents and senior citizens. This Act makes it a legal obligation for children and heirs to provide maintenance to senior citizens and parents, by monthly allowance.  The definition of “Maintenance”. As per Section 2 (b) , includes provision for food, clothing, residence, medical attendance, and treatment

Section 9(2) limits the amount of Maintenance to the Senior Citizens which is reproduced as follows:

“The maximum maintenance allowance which may be ordered by such Tribunal shall be such as may be prescribed by the State Government which shall not exceed ten thousand rupees per month.”

The Senior Citizens, too, deserve the same status of Living, including food, residence, clothing and other amenities, in the same manner as the married woman, under the various legislation is entitled from their Husbands. The ceiling Limit of just Rs 10,000/-, fettered the Senior Citizens, who in numerous cases get victimized by their Daughter-in-law, to enjoy the amenities which they are entitled. After the enactment of various legislations, the daughter-in-law puts various kinds of pressure on their “children”, by threatening and filing 498-A, 125 Cr.P.C, PWDV Act cases, in order to grab the valuable properties possessed by the Senior Citizens, as result the Senior Citizens often disentitled to various entities, which they, too, are to be entitled as per the same status of their children

Thus, ceiling Limit of RS 10,000 per month, as per made in Section 9(2) needs to be scrapped or amended, and it should be according to the Living standards of their children
