Allow Work Permit Holders to Change Jobs Without Employer's Consent

On 30 August 2020, Qatar passed a law ending the requirement for migrant workers to obtain their employer's permission to change jobs. Their reforms have rightly been welcomed by the International Labour Organisation, the International Trade Union Confederation, the European Union and other nation states.  We, the signatories of this petition, urge the Singapore Government to follow in Qatar's footsteps.

Presently, our Ministry of Manpower (MOM) requires holders of work permits to obtain the consent of their current employer to support an application for a new work permit by a prospective new employer.   This is a policy which, as far as we can tell, is not mandated by Singapore law and which is discriminatorily applied only to work permit holders, not to S-Pass or Employment Pass holders.

We call for MOM to abandon this policy, not only for the sake of low wage migrant labourers whose already weak bargaining power is further diminished by their employer's right to deny them access to alternative job opportunities, but also for the benefit of employers who will be able to recruit locally from a larger pool of experienced workers. 

Qatar believes its reforms "will benefit workers, employers, and the nation alike".  We believe MOM's policy of requiring an employer's consent to transfer to a new job is detrimental to workers, employers and our nation alike.  We believe it perpetuates a system in which low-wage foreign workers are held on an invisible leash by employers that enables and fosters exploitation. We believe it is unnecessary for the effective regulation and management of our foreign manpower resources.  We consider it a policy that no developed nation that professes to care about the welfare of its foreign workers can conscionably adhere to.  We consider that no individual should have the right to constrain another from taking up offers of employment.

We urge MOM to follow Qatar's example and abolish the requirement for work-permit holders to obtain their employer's consent to change jobs.
