Based on ORDER of Supreme Court [Civil Appeal No.10013-10014 of 2016 (arising out of SLP(C) Nos.33032 - 33033 OF 2015] EPFO head office issued implementation directives dated 23-03-2017 where millions of EPS95 pensioners would be eligible for revised pension on basic pay exceeding the maximum pay stipulated in the scheme.
However EPFO later issued advisory dated 31-05-2017 to all their field offices, denying the benefits to Pensioners of EPF Exempted but EPS un-exempted organisations, in clear violation of all the judgements and Apex court and High courts and approval accorded by the MOL&E/ Government.
EPFO for its administrative convenience (as per provisions in EPFO & MP Act 1952) created separate legal entities for the exempted establishments, thereby passing on the burden of day to day management of EPF funds and other actions through their extended arms i.e. TRUSTs, strictly in accordance with the rules and regulations of EPFO and are regularly inspected & audited. Where as management of Pension funds continue to be un-exempted and maintained by EPFO.
EPFO's unlawful interim advisory dated 31.5.17 has to be placed in Central Board Trustee (EPF) meeting for ratification of its decision and later forwarded to MOL&E for their approval. Meeting is scheduled in July 2017.
Therefore I have started this petition to Minister of Labour & Employment, New Delhi and to Central PF Commissioner, EPFO, New Delhi and also to all Central Board Trustees (EPF) not to consider ratification of the unlawful interim advisory dated 31.5.17 and immediately implement EPFO's implementation orders / directive dated 23-3-07 (which is in accordance withvarious judgments of the Apex court and approval of the Government) considering the welfare of the EPF 95 pensioners and Senior citizens..
