Our submission is that we as a Association of Certified Realtors of India (Regd.) strongly believe that it would be just and fair if we are treated in the similar manner as being done in the case of other professionals like architects, lawyers, chartered accountants etc. who can practice anywhere in India by taking licence once only.
We do understand that real estate is a state subject but for example Consultants like us who are based in Delhi are doing work for builders not only here but also for projects in Gurugram ( Gurgaon ), Faridabad, Noida, Ghaziabad, Meerut,Sonipat, Panipat, Mohali (Punjab), Jaipur and some of us are doing projects in Mumbai, Bengaluru, Goa, Shimla, Nainital etc as well. As per state rules, we have to register with the builder with our licence in every state is neither possible nor practical.
No where in RERA passed by Central Government, it is required for Real Estate Agents to take a separate licence for every state.Similarly in other states also the real estate consultants are bound to suffer. Firstly, It is not feasible to take licence for every state as this business is more based on personal requirement of a client who can be a NRI friend / relation or very close acquaintance and this requirement can be anywhere in India.
Secondly, RERA rules are going to be almost same except of minor twitching by various states which can be easily learned by an agent while taking up a project in a different state other than his home state.
Thirdly, if there is a default on the part of property agent than Regulator can send letter / summons to the permanent address mentioned on his licence as submission of a copy of the same is mandatory at the time of new booking or transfer with builder in case of resale.
Last but not least, as we all know that real estate is going through a bad phase, thousands & lakhs of young professional brokers who are dependent on it for their livelihood will become jobless.
Hon'ble Mr Modi's government agenda of providing more and more employment opportunities to young people and ease of doing business in India will get a boost if they are allowed to work on the projects anywhere in India and this will also act as a catalyst against corruption. Therefore we humbly request government to make a practical decision by implementing policy of "One India, One Real Estate Consultant / Agent, One licence".
