Justice for Kharma!

The Issue

Kharma Aleigha Figueroa was born on 02/02/2016, at a healthy 6lbs and 13oz, to Alexa Dutko and her husband, Daniel Figueroa.

A month after her birth, Kharma, who was once a quiet and easygoing baby, began to exhibit clear signs of distress with chronic crying, not wanting to be touched, changed or bathed by anyone other than her mother, losing weight and vomiting nonstop. Kharma, who at first had gained weight and was growing to her markers, was being taken to the pediatrician at least once a week. Initially diagnosed by the pediatrician with acid reflux while ruling out a virus, Kharma's weight began to plummet and she started making unusual eye movements, followed by a dazed and "checked out" look afterwards.

Alexa, Kharma's mother, and Daniel Figueroa, took Kharma to the pediatrician once again, due to her head suddenly swelling. They were told by the pediatrician to take the baby to the ER right away. At the ER, Kharma, two months old, having been seen by the doctors four times and having been to the hospital once, was immediately transferred to Cincinnati Children's hospital, where she had a brain and full body MRI done. The doctors determined that Kharma had a double brain hemorrhage, meaning that both sides of this baby's brain were filled with blood and fluids, causing seizures and pain; and that Kharma was, in fact, very close to death. Alexa was informed that if Kharma had not been brought to the hospital, she would had certainly died by the following morning.

The MRI also revealed that this two-month-old infant had fractures to her tibia, femur, shoulder, wrist, and ribs. Every joint in her legs and arms had some level of fractures. Kharma was rushed into surgery immediately, to insert drains to remove the fluid that was accumulating in her skull. As the baby was rushed into surgery, the hospital called CPS and the police, and they informed Alexa that they weren't certain if Kharma would survive the procedure or even recovery.

Alexa was immediately separated from her husband, Daniel Figueroa, and interrogated. In that interrogation, to Alexa's horror, she discovered the terrible extent of Kharma's injuries and what it really meant: that someone severely brutalized her new infant, and the only possible person who could had done so was her husband, Daniel Figueroa.

Daniel Figueroa was taken to the police station after Alexa's involvement in the abuse was completely ruled out by the detectives. An hour into this interrogation, Daniel Figueroa confessed to physically abusing Kharma, his own daughter, and added that "he was aware that he had hurt her and did nothing to seek treatment or confess, in order to get this two-month-old baby help."

Kharma had to stay in the hospital for a month, where Alexa was only able to hold her twice, for 15 minutes each time, due to the extent of her injuries and pain levels. Put on anti-seizure medication, having her eyes, ears, cognitive and motor skills checked daily; along with 24hr around-the-clock care of nurses, patient care workers, ongoing especialists and her mother, Alexa, and literally thousands of prayers rising for beloved Kharma Aleigha, this true baby warrior began to recover against all odds.

Meanwhile, Daniel Figueroa was charged on six accounts of felony charges by the police, without any discussion with the prosecutor's office. They also presented a case asserting that a full confession was recorded on tape, but upon Grand Jury review, it was not the clear-cut confession that the detectives had lead Kharma's family to believe: that Daniel Figueroa had admitted to dropping the baby from his knees and that he knew that he had injured her, and got her no help.

Because of what was shoddy police work and poor communication between the police to the DA's office, the Grand Jury ruled NOT to include Kharma's brain injuries in the case, in spite of massive medical evidence that she was suffering from a severe case of Shaken Baby Syndrome. As a result of this, five felony charges were dropped on what was almost certainly a murder trial, had the baby not received immediate urgent care. To add further insult to injury, Daniel Figueroa, abuser of his very own two-month-old infant, who was being held in Butler County Jail on a hefty bond, WALKED OUT of jail, free without bond by a local judge, due to errors in paperwork. Daniel Figueroa then fled jurisdiction immediately, fleeing to his stepfather in Prescott Valley, Arizona. Once Alexa's, Kharma's mother, notified the ADA's office of Daniel Figueroa's release and all possible places he would free to, Daniel Figueroa was soon found, apprehended, and eventually brought back to Ohio to await trial.

Meanwhile, after a month in Children's Hospital in Cincinnati, Kharma was showing great cognitive progress and was able to be sent home to recover. Four months later, however, she had to go back into neurosurgery, due to fluid building up in the frontal lobes in her brain. The doctors have determined that there's severe damage to her brain stem, thus the fluid building up in her skull, disallowing the spinal fluid to drain properly. This accumulation of fluid wasn't allowing the front orbital part of her brain to grow, and the pressure was pushing her eyes down.

The doctors have now placed a shunt in her skull to drain out all of the excess fluid into her stomach, leaving a noticeable apparatus in both her head and abdomen. The shunt is meant to be in place, at least, for six months to a year, in which they will determine if Kharma's body can drain out the fluid on its own. If it's determined that Kharma's body isn't able to do so, the shunt will have to be placed permanently.

The are NO charges brought against Daniel on the Shaken Baby Syndrome and the double-sided brain injury. He will NOT go up for attempted murder and is facing only five years max in prison, with a probable three-year sentence with time served.

The purpose of this petition is to appeal to Butler County, in Ohio, to press charges of Shaken Baby Syndrome and attempted murder on Daniel, and for him to face a longer jail sentence. We are also appealing that all of Kharma's medical records are reviewed during trial, and that the medical team is deposed to reveal the true horror of the crimes perpetrated upon an innocent infant who hardly cried at night and was born a quiet, gentle soul.

Due to Daniel's horrific abuse, Kharma is now facing the possibility of lifelong damage and suffering, being disabled and living in the emotional aftermath of not only the near-murder of her newborn life, but the terrible injustice of a judicial system that failed her, her mother Alexa Dutko, her two older siblings Orion (4 years old), Aurora (2 years old), and the extended grandparents and relatives who love this baby, Kharma, and the lifelong pain that will be left for all.

Kharma Aleigha is currently in the loving care of her mother, Alexa, who has been dragged through the CPS system, and even though has been completely exonerated of all scrutiny, has had her life and the life of her three children turned upside down and inside-out. Her two older children are terrified of losing the mommy, too, with Orion having witnessed some of the abuse, but also having to parent alone three babies with one disabled to a certain degree.
