On March 26, 2015, there will be a hearing to decide on 2 counts of negligence filed against Dr Jan Pol. These proceedings were initiated by a complaint filed by a person who saw an episode of The Incredible Dr. Pol and took issue with some of the show footage. In the episode, a Boston terrier named Mr. Pigglesworth was brought to the clinic after being hit by a car, which resulted in his left eye dislocated from its socket and a broken pelvis. Dr. Pol treated him for his injuries and Mr. Pigglesworth is now fully recovered and doing well. Based on footage from the TV show, the State alleged that Dr. Pol violated certain “minimum standards of care” in treating the Boston terrier. Mr. Pigglesworth’s owners however, are very happy with Dr. Pol’s treatment of him and wrote a letter to the State of Michigan that the operation and care provided to Mr. Pigglesworth was done to their complete satisfaction and in a cost effective manner that they could afford.

The State’s Regulatory Affairs Board investigation of the matter was flawed in certain key areas:

1. Expert testimony: The judge assigned to the matter, who has no veterinary training, gave greater credence to the State's paid "expert” (who operates a minimal practice) and dismissed the sworn testimony of two Michigan veterinarians, who operate exceptionally busy practices, and stated that Dr. Pol DID meet the appropriate standard of care.

2. Budgetary constraints: The Board dismissed as irrelevant the financial constraints of Mr. Pigglesworth's owners and what they could afford to pay. The Board felt entitled to intervene in the care that was agreed to between Dr. Pol and the dog’s owner.

3. Arbitrary standards: The “standards of care” cited by the Board are NOT state law and were arbitrarily applied to this case.

We support Dr. Jan Pol and the standards of care that he utilizes in his practice. We insist on good care at an affordable price and that is exactly what we get with his 34 years of service in the State of Michigan operating Dr. Pol’s Veterinary Service. We ask that you reverse the Michigan State Licensing & Regulatory Affairs Board findings and allow Dr. Pol to continue serving his community.
