Dans le cadre du projet de loi "Liberté de Création, Architecture et Patrimoine", le gouvernement a déposé un amendement afin, dit-il, de favoriser l’exposition des pratiques artistiques en amateur « sans pour autant fragiliser la présomption de salariat ni constituer une concurrence déloyale vis-à-vis des artistes professionnels ». Cet amendement a été adopté par  la commission des affaires culturelles  en charge d’étudier le projet de loi et d’examiner les amendements déposés.

Nous nous réjouissons de cette initiative car nous sommes attachés depuis toujours à ces pratiques si essentielles à l’éveil et l’émancipation des citoyens.

C ‘est pourquoi nous adhérons sans réserve aux paragraphes I et II de cet amendement qui définissent à la fois les amateurs et les conditions dans lesquels ils doivent pouvoir exposer leurs pratiques au public.

En revanche le Paragraphe III, par dérogation aux articles du Code du travail garantissant les droits élémentaires des artistes interprètes, permet aux entreprises de faire participer des « amateurs » à des spectacles faisant l’objet d’une exploitation commerciale sans les rémunérer. Il ne répond en rien aux besoins légitimes des artistes amateurs, mais fragilise tous les professionnels du spectacle, qui risquent ainsi de ne plus être dûment rémunérés et de voir l’ensemble de leur protection sociale remise en cause par cet appel légal au dumping social.

C’est pour cette raison que nous, professionnels du spectacle, amateurs, public, demandons le retrait de ces dispositions qui sont désastreuses pour les artistes et sont, de fait, le prélude à la remise en cause du Code du travail pour l’ensemble des salariés de notre pays.

Do Not Vote for the Destruction of Our Professions!

In the bill for a law on “Freedom of Creation, Architecture, and Heritage”, the French government has proposed an amendment aimed, the government says, at promoting the visibility of amateur practices, “without rendering plus precarious the presumption of employee status that performers legally enjoy, nor creating unfair competition with professional performers”. This amendment was adopted by the parliamentary cultural affairs committee in charge of examining the law and its suggested amendments.

We appreciate this initiative, because we have always favored these practices, essential to consciousness-raising and the full liberation of citizens.

That is why we fully support paragraphs 1 and 2 of the amendment, which define the notion of amateur and the conditions in which amateurs should be able to display their practice before a public.

However, paragraph 3 creates exceptions to articles in the Labor Code that guarantee the fundamental rights of performers, allowing companies to use “amateurs” in commercial productions without paying them. This is not an appropriate response to the legitimate requirements of amateur artists, and seriously weakens the status of all performers, who risk no longer being properly paid and seeing their whole social protection system sapped by this call to legalize social dumping.

That is why we, entertainment industry professionals, amateurs, members of the public, demand the withdrawal of this clause, which is disastrous for performers and constitutes, in fact, the prelude to an attack on the Labor Code for all employees in our country.
