Hello Supporters,

We have news to break regarding a previously unreported civil rights lawsuit against Albany Care, which was filed three months ago in federal court. 

On August 29, 2025, a former employee filed a civil rights complaint against Albany Care, Inc "seeking redress for Defendants' race-based discrimination, race-based harassment, and retaliation under Title VII.”

This complaint, which includes a demand for a jury trial, has not yet been adjudicated in court. 

The plaintiff's filing, and Albany Care's response to it, was obtained through a search of public court records. We have redacted both documents to remove all names contained within them, including those of the plaintiff; Albany Care employees; the Judge assigned to the case; and attorneys for both parties.

In the original complaint, lawyers for the plaintiff detail an alleged incident from July 3, 2025, in which their client, who was an Albany Care employee at the time, left the facility to help a family member jump start her car on a nearby street. After the plaintiff returned to Albany Care, she alleges that her supervisor, who is white, told her "I'm writing you up because you were with your ghetto-ass cousin.”

The complaint states that the plaintiff reported the incident to Human Resources, then told staff she was leaving the facility early that day due to emotional distress. Later that day, the plaintiff received a text message from the supervisor -- the same individual who allegedly made the remark at issue -- telling her that she had been fired. As the complaint states:

“A few hours later, while Plaintiff was preparing a formal written complaint of racial discrimination, she received a text message from [the supervisor] informing her that her employment was terminated and instructing her to retrieve her belongings the following Monday, July 7, 2025.

The plaintiff's complaint alleges that her firing was retaliatory in nature.

On November 3rd, lawyers for the defendant, Albany Care, Inc., filed an answer to the complaint. Among other points of response, Albany Care's lawyers deny the following:

  • That the supervisor made "any racially charged or derogatory remarks”
  • That other employees of Albany Care witnessed such remarks
  • That the plaintiff reported the incident to Human Resources

In the response, lawyers for Albany Care claim that the plaintiff left the facility during “her 10-minute assigned break" and that "under protocol, [the break] is required to be taken inside the building.” As for the reason for the plaintiff's firing, Albany Care's response states: "Defendant admits only that Plaintiff’s employment was terminated shortly after she violated company policy and left work early, and denies all remaining allegations in Paragraph 23 of the Complaint.” 

On November 18th, the Judge assigned to the case set a discovery schedule. We will continue to monitor this case as it unfolds.
