Petition Supporting TRO Suspending Prop 64/SB94 Pending Jury Trial Decision.
The Issue
California's Prop 64 was a voter approved initiative passed in the November 2016 elections. Prop 64 was, and is, a void contract/law as it mandates that to be engaged in a state "legal", for-profit cannabis industry, the licensee(s) must violate higher federal law under the Controlled Substances Act (CSA) and in direct opposition to the federal Supremacy Clause which is federal controlling law whenever there is a positive conflict between state and federal law.
We ask that those who would support a return to the law(s) and regulation as had been previously set forth in Prop 215, The Compassionate Use Act( CUA) and SB 420 both of which provided for a not-for-profit exchange of medical cannabis, law that met the will of the people and did not engage in establishing law and regulation that would be in direct violation of higher federal law be enacted under a Temporary Restraining Order (TRO) that will suspend Prop 64 licensing and enforcement while installing the Restoration Act until such time that a jury would fully consider, and the issues (i.e. damages) be adjudicated, that are being raised within the forthcoming COTTON v STATE OF CALIFORNIA complaint.
