PETITION THE CITY OF ERIE, PA TO LIMIT THE USE OF FIREWORKS

The Issue

PETITION SUMMARY AND BACKGROUND: In 2017, the use and type of fireworks was changed by the State of Pennsylvania, Act 43 of 2017. Article XXIV has written five prohibitions, they include in part, a) you cannot set them off if you are under the influence of drugs or alcohol, b) you can’t set them off from, within, or toward a building or vehicle, and the most important one is that “A person may not intentionally ignite or discharge consumer fireworks, within 150 feet of an occupied structure.” In the City of Erie, the police have not consistently enforced the 150 feet element. In addition, people shoot fireworks off at all hours. This is upsetting to pets, small children, people with PTSD, senior citizens, and people who need sleep because they have to go to work the next day. They are also a fire hazard. Recently fireworks have been weaponized against law enforcement officers during looting episodes following peaceful protests. Some states limit the ability to shoot off fireworks to Federal Holidays, some to Federal Holidays plus the day before and the day after. We hereby request the City of Erie, Pennsylvania to place restrictions on not only the days that fireworks can be used, but also add language that includes a cap on the hours that they can be shot off, for example, no later than 10:30 p.m. and enforce the limitations when citizens reach out for assistance from the police.
