Investigate use permits for methadone clinic on Virginia Street
The Issue
It is our understanding that PROMESA, Inc. (a/k/a Acacia Network, Hispanics United of Buffalo) has failed to obtain a regulated use permit to operate a methadone clinic located at 254 Virginia Street in the City of Buffalo. Pursuant to City of Buffalo Charter and Code § 511-136 the operation of a community substance abuse treatment facility is a "regulated use" requiring approval from the Zoning Board of Appeals of the City of Buffalo of a Restricted Use Permit prior to establishment of a methadone clinic. It now appears PROMESA, Inc. is operating a substance abuse treatment facility in violation of Code § 511-136.
We the undersigned hereby request the Common CounciI, and the Mayor of the City of Buffalo to fully investigate if PROMESA has obtained the Restricted Use Permit required under Buffalo Charter and Code § 511-136 , and if it is determined they have not direct the Commissioner of Permits and Inspection Services to Order and Direct PROMESA to cease all restricted activities at the Site until a determination is made by the Zoning Board of Appeals as to whether or not 254 Virginia Street is an appropriate location for the operation of the proposed methadone clinic.
