As of July 12, 2021, the Arizona Supreme Court denied the Attorney General's request to speed up the filing process in order to execute Frank Atwood before the lethal injection drugs expire. The Supreme Court’s decision cited the state’s revelation that it had relied on false information about the shelf life of its execution drugs.
The Arizona Attorney General's office was quoted as stating, in response to the above ruling: “Too often we focus on the convicted killers in these cases even after they’ve exhausted all their appeals. Justice delayed is justice denied.” Wow. Sounds like constitutional rights should not extend to prisoners, according to the Attorney General.
The judge has asked the state to test the drugs to see how effective they are beyond their shelf life. This means that once the state provides testing results to the Supreme Court, a warrant could be filed with a new execution date, very soon.
Another interesting statistic: as of May 31, 2017, the National Registry of Exonerations (i.e. exonerations from Death Row) reports that official misconduct was a contributing factor in 571 of 836 homicide exonerations 68.3%, very often in combination with perjury or false accusation, which also was a contributing factor in 68.3% of homicide exonerations.
