There is no equal Justice for the vulnerable in disabilities in Australia - we must not remain silent when injustice is allowed….and there is no justice for the the indigenous its the same...Animals seem to get a more fair go than our disability children!   Take for instance the recent protests in Sydney where all the media could talk about was the police horse being hit, and its ok the horse is alright now.

When my son got hurt in a respite house with a assault to the head, I believe by a worker who was removed from James at my request, the police did not take interest in investigating the worker and actually did not meet my son.   At least they did send a police car to the respite house.  That was something.   They said he probably fell over, kids get bruises all the time they refused to do anything concrete about it.  They wont believe when someone attacks a disability kid like my son who is quiet gentle and cannot defence himself.   Much like the police horses they cant defend themselves either or talk about it.

Recently when James was punched to the arm and received deep trauma injuries at the NADO day program the police did not ask the organization about it until six weeks later with a phone call.  I took him in to meet them this time and said my son needs body cameras like you guys.   Look at his bruises I dont want him to go through this all his life.  He cant speak.  Get it?  They said they would send a patrol car out to the day program.  They never did.  

But a police horse, they matter so much more! WE have to feel sorry for the horses yet not the human beings who are not being protected in care with no CCTV cameras being made mandatory.  Horses are so much more important.  How sickening the values are of the justice system and media in Australia who plays up what the government wants it to say.

Noted on Article 5 of the Convention for the treaty of Disability Rights written up by the UN which Australia signed:
“ Article 5
• States Parties recognize that all persons are equal before and under the law and are entitled without any discrimination to the equal protection and equal benefit of the law.”
Those with disabilities are to be recognized as equal and under the law and entitled to equal protection and equal benefit of the Law - I have not seen this happening and yet Australia signed this treaty. Where is the equal protection and equal benefit? It is unequal.
The police chase down people for going outside their areas to a supermarket somewhere else, but do not chase down disability providers who hurt our children, or their workers.
When my son was assaulted to his head at Life without Barriers, they would not interview the worker, they would not investigate properly.
Now however, they would rather chase up people who don’t wear masks what a crime or went shopping. Gee that’s so bad. What about chasing real criminals like the providers who hurt our children who cannot defend themselves? Shame on the police and the justice system, and all the premiers who have no compassion choosing to be money mongers instead. A society that cares about itself not getting sick, but doesn’t care about those who already suffer sickness, or disabilities and intellectually and physically. How selfish are that?
If someone is harmed or assaulted they will be prosecuted under Australian Law. If a disability person is assaulted they are ignored. If someone dies through neglect or assault under Australian Law the offender will be prosecuted tried, sent to prison or given some kind of punishment. If a person with a disability dies through neglect or killed rarely is the offender punished, suspended or prosecuted the situation is ignored not treated seriously by the police and not acted upon in the justice system. This needs to change!
This is not equal justice for those in disabilities at all! Yet Australia has signed an international agreement to say that those with disabilities will not be discriminated against by the Australian law. Noted even by the Attorney General’s office - The Australian Attorney General – yet they fail to carry this out every time a disability child or person is hurt. There is no regulation of providers of disability services. The NDIS quality commission is biased and does not do unbiased investigations of its own providers. WE need an independent organization that investigates the disability providers and makes them accountable..
Nation states throughout the world committed to equality of law protection for disability persons yet Australia has failed to carry this out –
“ Equal protection and equal benefit of the law
Article 5 of the CRPD reaffirms that people with disability are entitled to the equal protection and equal benefit of the law. Similarly, article 12 - commits countries to ensuring that people with disability can exercise legal capacity in all aspects of their life and receive appropriate support to do this if required.
Why are we participating in the Olympic Games or even holding them when we do not honor agreements with the United Nations regarding the vulnerable in our country? How double minded. Premiers have desire for money flowing in their veins but no heart or drive for human rights at all. They are despicable.
Our children who have disabilities particularly intellectual disabilities do not get justice if they are harmed, or even die – without evidence the police will not make it a criminal investigation and they will not make the effort to even investigate as they marginalize our disability children and adult children by not caring what happens when they are harmed. Writing it off to the disability. I hear of cerebral palsey children dying and they say they choked or whatever, but really 42% were preventable but the workers never listened to instructions or were never given proper instructions. This should not be! Don’t call it an unexplained death. That is just a lie. Its explainable but the lying providers refuse to explain or confess what really happened.
WE must as parents make the providers accountable, or they will continue to hurt those who are non verbal and literally cannot speak . Merna, a 19 year old sweet girl, died at Afford disabilities and there still has been no prosecution or suspension of that organization perhaps they are too much in the money and the government departments don’t care, the NDIS hardly investigates its own providers properly, they do half investigations and sweet talk their way out of any further action. Where is justice for Merna?
What did Stuart Robert do about it? Or what is Linda Reynolds waiting for? Why is there not instant suspension when a disability person dies in the care of a provider, a rich money making provider.
Yet would NDIS CEOs of companies, administrators, and providers like their children to die or be harmed in any way? I think not. They would be up in arms they would hire their lawyers. Maybe they would use CCTV footage that is used in all crime situations. Except disabilities there are no CCTV cameras put in most respite, care or accommodation places, because they are not mandatory.
To be silent is to let the criminal providers win and hurt more and more vulnerable children when they were meant to be caring for and protecting them, and this should not be allowed to happen any longer. WE must protect our children and fight for CCTV cameras to catch and punish those who would harm our dear ones and the dear ones of other parents who are too scared to stop it.
I was very sad to hear another indigenous man has died in custody a few weeks ago (The Guardian 14th July 2021 Lorena Allam) on the 8th July two days before my birthday, the day I was born, someone has died and he died alone in Long Bay prison. The worst part is for someone to be alone and isolated his family suffers thinking of him dying alone. It is awful and horrifying for them. We in Australia are tasting this a little of what it is like to be alone, with the isolation treatment being ordered throughout each state…a cruel and unusual torture for any humans is to be completely alone and in solitary. Which is what happened to Coleman. They often put him in solitary. It is cruel.
The man’s family cannot even find out how he died or why? Yet where are the CCTV cameras – the prisons are riddled with them. Somebody knows something. They must know how he died. Maybe they better speak up instead of protecting their own little agendas. Apparently the prison is investigating. Now where have I heard this before. An organization investigating itself never comes up with an unbiased answer or any answers. Just like disabilities. We need independent investigations.
The Guardian notes that this was the fourth death of an indigenous person in custody since April and this was the 30th year since the royal commission made recommendations to address the deaths in custody and still it continues.
What is the use of Royal Commissions if nothing changes. What is the use of our disability royal commission if nothing changes in disabilities as well? Will the NDIS or State governments still not put in mandatory CCTV cameras? Will they still let our children be harmed by providers, their bad workers while the good ones too afraid to speak up. The providers will still say their policy is no abuse or harm while they abuse and harm our children! How dare they!
My condolences to the Coleman family, this is just so wrong another unexplained death continues in a place of justice where there is no justice for those who are aborigine. It is a great wrong, it is a great crime to let people die, or especially cause their death whether purposely attacking them or just neglecting them when they needed help or medical care. In this case his family says he was in good health. No death should be unexplained especially not in prison where everything has surveillance. If it is a justice system why is there no justice? Discrimination should not be happening in a justice system, yet there it is and the same for disabilities they very rarely get justice at all. It is covered up swept under the carpet and ignored by the Police.
There are also unexplained deaths in disabilities. its time some explaining was done. The providers always say they don’t know what happened but someone always knows they just don’t want to tell. We need the cameras to expose what is happening in disabilities and stop people hurting our children who cannot speak up about it literally unable to, and are traumatized. Since workers are so scared of saying anything and the providers don’t want their precious reputation tarnished so they stop making money out of disabilities! They should be in prison too. Where is the justice?
My son came home with a swollen head from Life without Barriers in 2019 and they replaced the worker at my request, the police at least that time visited the respite house but said they could do nothing without camera evidence they explained it away as maybe he fell over, its only a bruise, kids get those all the time. James never falls over. Stop all the excuses. My sons head still has a bump and is swollen now because he keeps touching it. A continual reminder of the lack of care or justice for our children when they get hurt..
Then James came home with bruises to his arm from the day program at NADO – the police never investigated and made a phone call to NADO after six weeks! they both said they don’t know how it happened, it’s a mystery, we will probably never know…spare me - these organizations need to be exposed for what they do to our children and we need to say no to violence and not let them get away with it any longer. The wolves who say they care for our children are doing the opposite and their main motivation is money for themselves and their CEOs.
My son had funds taken by Life without Barriers without my knowledge until I discovered it and they denied it. May they pay for the false agreements they made and took my sons funds with – may they learn a lesson one day. How dare they exploit my son who cannot defend himself. Shame on them. The day of reckoning will come I sent it to the fraud department and the police at the time they must not be allowed to get away with all their deviancy. Make them accountable. We must champion our children’s and adult children’s rights and fight for them.
