The Issue
In the summer of 2024, my son fell victim to an auto-pedestrian accident. The driver, who could have possibly been impaired, was not given a sobriety test of any kind. It is heartbreaking to think that my son's tragic incident could potentially be due to a loophole in the law. The absence of any immediate sobriety test after such mishaps leaves the victims and their families helplessly dealing with a possible injustice.
Based on statistics from the CDC, an estimated 29 people die in the US from motor-vehicle crashes involving an alcohol-impaired driver each day. That's one death every 50 minutes. Implementing a mandatory sobriety test for drivers involved in auto-pedestrian accidents could help to mitigate these numbers (CDC, 2016).
But this is not just about statistics. It's about victims and families, like ours, who were left in the dark, not knowing if alcohol or drugs played a role in our loss. Having mandatory sobriety testing would give victims and families some clarity about the circumstances, and help in the pursuit of justice.
Therefore, it's critical that a law be put in place to require sobriety testing for all drivers involved in auto-pedestrian accidents, irrespective of the situation.
