The issue

Too many women have become statistics, losing their lives at the hands of violent partners or ex-partners who were released on bail, despite having been arrested for domestic violence or domestic abuse offences. The tragic and preventable deaths of these women have left shattered families and devastated communities in their wake. It is time to take a stand and demand change to protect the most vulnerable among us.

The current bail system often places victims of domestic violence in further danger by allowing their offenders to walk free while awaiting trial. This not only exposes victims to further harm but also forces them and their families to seek refuge, often in shelters, to escape the threat of their abusers. Such displacement can have lasting traumatic effects on victims, particularly children, disrupting their lives, education, and sense of security.

In light of these grave concerns, it is crucial for the judiciary to mandate a no-bail policy for those charged with domestic violence or abuse offences. By requiring magistrates to order remand in custody, we ensure that victims can remain safely in their homes and that perpetrators face the full consequences of their actions without the opportunity to repeatedly harm their victims.

According to studies, individuals charged with domestic violence are more likely to reoffend if released on bail. The Australian Domestic and Family Violence Death Review Network found that many domestic violence homicide cases involved perpetrators who were on bail at the time of the incident.

Implementing a no-bail policy would not only protect victims and their families but also send a strong message that domestic violence will not be tolerated in our society. We have a moral obligation to safeguard those who are vulnerable and to ensure that justice is served.

Join us in calling upon our legislators and judiciary to amend existing laws and protect victims of domestic violence by mandating a no-bail policy for offenders. Sign this petition and help create a safer future for all women and children at risk.
