Mandate HOA Accountability and Transparency

The Issue

I've been caught in the quagmire of dealing with a Homeowners Association (HOA) that seemed to wield its power without accountability. This came into sharp focus when I challenged a violation notice only to be met with silence; my HOA took no less than 18 MONTHS to reply, and even then, they only shifted the grounds of the violation. This disconcerting experience was compounded by their refusal to communicate, even when I had legal representation. I agreed to the HOA's demands under duress, expecting fair play in the form of a refund for unwarranted fines – a request they took another 5 MONTHS to deny. This frustration is not unique; it's shared by countless homeowners across the nation who find themselves at the mercy of opaque and unyielding HOA boards.

It's time we bring change and introduce legislation to assert the accountability of HOAs. To ensure homeowners are treated with the respect and fairness they deserve, the following measures must be put into law:

1. HOAs should be mandated to respond to any homeowner or their attorney's correspondence within a 30-day window. This will prevent issues from languishing unresolved and ensure timely communication.

2. If a dispute remains unresolved, HOAs should be required to participate in mediation or arbitration within 90 days. This would offer a path to resolution without burdening homeowners with prolonged waits.

3. HOAs need to hold at least three public meetings per year outside of standard work hours, enabling homeowners to participate without having to rearrange their professional lives.

4. New rules, regulations, or alterations should not be passed without a transparent voting process. This ensures that the voices of those affected by these rules are heard and considered.

These measures will help curb the misuse of authority by HOAs and promote a more transparent, fair, and democratic process that protects homeowners' rights. To fix an often omnipotent HOA system, we must demand more accountability and dialogue—acting together, we can make it happen.
