Mandate EZpass to reform their ABUSIVE billing practices.

The Issue

Are you one of the millions of EZpass customers that are fed up with EZpass' abusive billing practices?


Ezpass, Port Authority, MTA and NY Thruway have created the perfect money making scheme. Create a cashless tolling system by mail, then knowingly and deliberately lie to the public by claiming it is to help ease traffic congestion at tolling areas, DON'T offer any options to electronically receive statements by sms text message to a mobile device or email, then charge $50 unpaid violation fees in advance, basically as soon as the bill is "generated" in their system, then deliberately wait for months to pass to then mail (or not mail) a toll bill so that they can claim that these numerous excessive $50 violation fines are "legally justified". These abusive billing practices generate a substantial profit, and many suspect and believe EZpass, NY Thruway, MTA and Port Authority are dividing up the profit generated from their abusive billing practices, and splitting it amongst themselves, all the while they are constantly claiming they have a deficit. 

The IRS, NY State Dept of Taxation and Finance and any other relevant agency needs to AUDIT the MTA, EZpass, Port Authority and NY Thruway Authority in order to determine why they still continue to have a deficit.

In addition, We as consumers are tired and fed up with the lack of communication between EZpass and us and we respectfully request that NY State Legislature mandate EZpass reform their abusive billing practices in accordance with state and federal consumer protection laws.

We DEMAND that:

1) EZpass be mandated to mail out toll bills within 7-14 days after the bill is generated.

2) Offer electronic notification/paperlesss statement options to customers via text or email that will allow customers to be notified immediately of an outstanding toll bill.

3) Prohibit EZpass from charging $50 unpaid violations per toll. Violation fees should be charged PER BILL as opposed to per toll. This way, we can avoid customers being unjustly slapped with violation fees that add up to more then what the customer earns annually. 

It is highly unreasonable to be disproportionately charged a $50 violation fee for tolls that are $20 or less. Violation fees should not cost 150% more then the original toll. 

4) When the tag of an EZpass holder doesnt read correctly, that EZpass holder should be charged the EZpass rate on their toll bill, NOT the full rate. We feel that EZpass is being dishonest by charging ezpass tag holders the full toll rate when the cameras at the tolling area failed to detect their tag. 

5) If they receive no response from motorists 30 days after sending the toll bill, they need to take further steps such as sending toll bills via USPS CERTIFIED mail. 

 


6) EZpass should be required and mandated by law to offer payment plans for customers who can not pay. No one should have to chose between paying their rent and risk going homeless, and paying thousands of dollars to EZpass in bogus fines. 

 


Step 7) The state government should Prohibit EZpass from being allowed to seize vehicles UNLESS they can provide LEGITIMATE PROOF that other steps were taken and exhausted in their attempt to notify the vehicle owner. There are many accounts of customers having their car seized while driving on the highway, and then being left stranded on the highway with children. This is reckless endangerment and if someone is harmed because of this, EZpass should held liable.

 

Banks and credit card issuers are alot more reasonable then EZpass is. They dont charge a late fee per transaction so why is EZpass allowed to charge a violation fee per toll?
