My Federal Court Application was Successful

On 30 November 2018 the Federal Court Judgment was delivered for my Application for leave to appeal the dismissal of my Consumer Protection action against the Commonwealth Bank on 27 April 2018. My application was successful. The Judgment has been published on the Federal Court website: http://www.judgments.fedcourt.gov.au/judgments/Judgments/fca/single/2018/2018fca1908.

Unfortunately my Consumer Protection action against the Commonwealth Bank is still unresolved because now I have to complete and lodge a formal Notice of Appeal in the Federal Court. This is an extremely complex task for any self represented litigant. Hopefully, because the Federal Court Judge approved a Referral Certificate, a lawyer will be prepared to help me on a pro bono basis. If not, I will have to continue to write my own court documents and try to interpret the court Rules, etc., as best as I can.

When I commenced this petition I made it clear that the reason for my fight for Justice is because the Commonwealth Bank had not provided any evidence whatsoever to support that it did not breach its legal lending obligations in the National Consumer Credit Protection Act 2009 and the Code of Banking Practice 2013 in November 2015. This situation remains unchanged. This is all I can say for now.
