On 8 September 2017 I received a letter dated 30 August 2017 from the office of the Federal Treasurer in response to my contact with the Prime Minister on 11 August 2017 about my concerns of Corruption in the CBA and FOS. The information I provided about the CBA was ignored. I was advised that like ASIC, the Australian government has no authority to review or overturn the decisions of FOS or to direct FOS in any way. This means that FOS operates without any external supervision even though FOS derives its income from the Banks.
The office of the Federal Treasurer advised me that I can voice my concerns through the FOS feedback mechanism and review process, which I had done on 6 September 2017. I was also encouraged to pursue my complaint against the CBA in a court of law because the Australian government provides funding to enable disadvantaged Australians like myself to access pro bono legal assistance in civil law and financial disputes. Unfortunately, this is not the case. I emailed the office of the Federal Treasurer on 26 September 2017 to advise that this information is incorrect and I asked for help with this because I have been unable to obtain any legal advice to even tell me what court of law would handle this type of dispute and what type of application I would need to complete.
Based on further legal advice I did not sign the CBA Resolution Agreement yesterday because of the gag order and because my FOS complaint against the CBA will not be finalised until I receive the review of the FOS Chief Ombudsman.
I forwarded my response to the CBA to the office of the Federal Treasurer today in case the CBA still tries to steal my home and evict my companion animals and I onto the side of the road which will place all our lives in serious danger.
The legal advice I received is that the CBA cannot do this until the FOS review process is completed and then, if necessary, the court process is completed. However, the CBA has proven to me that they think they are above the law. I have already raised my concerns about this with the office of the Federal Treasurer. He is aware that Ian Narev, CBA Chief Executive Officer ignored my complaint and the evidence I provided on 11 April 2017.
Irrespective of the structure of FOS I do not believe the Federal Treasurer, on behalf of the Prime Minister, should do nothing when an Australian provides written evidence to prove that the CBA has acted unlawfully and a FOS Ombudsman has acted dishonestly.
I have done all that I can to promote this petition but unfortunately there continues to be little interest. I will update you with any future positive or negative developments.
