On September 1, 2023, the Texas Legislature passed House Bill 4122 which updated the Transportation Code. This bill officially banned motorcycle "lane splitting". It does not provide any exception for "lane filtering" which is the practice motorcycle riders use to navigate heavy traffic safely by responsibly moving between two lanes of cars. The existing law needs clarification by establishing guidelines around safe lane filtering.  

In the last two years, Minnesota and Colorado legalized motorcycle lane filtering. They join California, Utah, Arizona, and Montana. These states have strict and responsible guidelines which allow for lane filtering. Texas should follow suit and join these states by modifying our existing lane splitting laws so everyone stays safe and can filter through traffic. No one wants to see riders lane splitting at high speeds in fast moving traffic. 

Motorcycle lane filtering, a practice where motorcyclists move between lanes of slow-moving or halted vehicles, has proven to be an effective measure in many jurisdictions worldwide. Countries like Australia, the UK, and states such as California in the US have already enacted lane filtering laws with notable success. These regions have reported reduced traffic congestion, lowered emission levels, and fewer accidents. Adopting similar legislation in Texas could pave the way for safer and more efficient roadways.

The benefits extend beyond motorcycle riders. With more commuters opting for motorcycles, which take up less space, there is an overall decrease in traffic congestion, making the drive smoother for everyone on the road. Further, by reducing the stop-and-go nature of traffic, emissions from idling vehicles may be significantly reduced, contributing to cleaner air.

Moreover, lane filtering enhances safety for motorcyclists. By minimizing the time motorcycles spend in blind spots or between larger vehicles, the potential for collisions decreases. This is not merely a matter of convenience but one of safety and security for tens of thousands of Texans.

To address potential concerns, lane filtering regulations can include clear guidelines and conditions under which it is allowed. For instance, only permitting lane filtering when traffic is moving below a certain speed or when deemed safe by traffic authorities, ensuring it is executed responsibly and safely.

I urge the Texas Department of Transportation, the Committee on Transportation and our state legislators to consider the adoption of motorcycle lane filtering laws. The potential improvements to traffic flow, environmental health, and road safety speak for themselves.
