The Issue

Parking on residential streets across Derby is becoming increasingly difficult. Many ordinary residents struggle to find a legal place to park near their homes, particularly in the evening, late at night and around midnight.

For residents returning home late from work, caring responsibilities, social activities or other commitments, it can be extremely frustrating to drive around looking for a legal parking space when the available spaces have already been taken.

At the same time, there is considerable confusion about residential disabled parking bays and what they legally mean.

Derby City Council's published guidance states that residential disabled parking bays provided through its scheme can be advisory only and are not enforceable because they do not have a Traffic Regulation Order attached. The Council also states that such a bay is not for the exclusive use of the resident and can be used by another Blue Badge holder.

This information is not widely understood. Some residents may believe that a disabled parking bay outside their property is their private or permanently reserved parking space. This can lead to misunderstandings, arguments and unnecessary disputes between neighbours.

We are not asking for disabled parking provision to be removed, and we recognise the importance of accessible parking for disabled residents.

Our concern is that all residents should understand the rules clearly, especially when parking is already under significant pressure and ordinary residents may return home very late at night with no other legal parking space available.

We ask Derby City Council to:

Clearly explain the difference between advisory residential disabled bays and legally enforceable disabled parking places.

Clearly explain who can use each type of bay and what rules apply.

Make clear that an advisory residential disabled bay is not private property or exclusively owned by the resident.

Provide a simple information leaflet to residents when an advisory disabled bay is installed, explaining its status and the applicable rules.

Consider clearer signage or information plates, where appropriate and legally permitted, so motorists can understand the status of the bay.

Consider a public awareness campaign through the Council website, social media, local community groups and other appropriate channels.

Provide clear information about the rules concerning cones, wheelie bins and other objects being used to reserve parking spaces on the public highway.

Consider whether additional measures are needed in areas experiencing severe overnight parking pressure, so that residents have clearer information about available legal parking options.

Why this matters
Parking pressure affects many Derby residents. Someone returning home at midnight may drive around their neighbourhood repeatedly trying to find a legal place to park, while very few spaces are available.

This situation can create frustration and conflict between neighbours, particularly when people have different understandings of whether a particular parking bay is private, reserved or advisory.

Residents should not have to rely on hearsay, social media posts or arguments with neighbours to understand the status of a parking bay.

At the same time, disabled residents should not have to deal with unnecessary conflict over parking arrangements intended to assist them.

We believe clearer information can help everyone.

This petition is asking Derby City Council to improve communication about residential disabled parking bays and to consider practical ways of helping residents understand their legal parking options, particularly in areas where overnight parking is under significant pressure.

Our message is simple:

Clear rules. Clear information. Less confusion. Less conflict. Fairer understanding of Derby's public parking spaces.

Please sign and share this petition if you believe Derby residents deserve clear and accessible information about residential disabled parking bays and clearer guidance when parking is difficult, particularly late at night.
