The company responsible in destroying the peat forest in Rawa Tripa, called PT. Kallista Alam (PT. KA), has been convicted by the court. But the execution process continues to delay.

In 2014, the Ministry of Environment and Forestry won the lawsuit to punish PT. KA in Meulaboh State Court (PN).

PT. Kallista Alam was found guilty of burning 1,000 hectares of peatland in Rawa Tripa, Aceh. They must pay the compensation of Rp 366 billion to the state.

PN Meulaboh's ruling was finally a permanent legal force in 2016, after going through the judicial process in the Supreme Court of Indonesia the level of appeal, cassation, and even judicial review processes.

Right now it’s 2021, they should have paid the sanction, right? No, you are mistaken! To this day, PT. Kallista Alam has not paid any compensations and the case has not been completed.

Today, the case is handed over to PN Suka Makmue, a new state court established after the case was decided by PN Meulaboh.

PN Meulaboh delegated the execution of this case to PN Suka Makmue because of the location of PT. Kallista Alam and the burned forest are in the jurisdiction of PN Suka Makmue. Did PN Suka Makmue carry out the verdict execution? Not really. Instead of being done, the case was left hanging.

PN Suka Makmue has not conduct the verdict execution. Various reasons are conveyed, even reasons that do not make sense. If this ruling is not implemented, then what is court trial for? Where is the legal power of a Court verdict? Where is the legal certainty?

Therefore, we ask the Supreme Court to take over the execution of PT Kallista from PN Suka Makmue to guarantee legal certainty and show the legal binding of a court verdict.

We believe that the Supreme Court will have the courage and authority to execute the verdict against companies found guilty of damaging tens of thousands of hectares of our forests.

In 2014, our people, and even the international world, applauded the verdict, but if it could not be implemented, are we still clapping our hands?

Successful verdict execution of PT. Kalista Alam will be a precedent for the implementation of judicial executions, especially environmental civil law. In addition, the fine will become a non-tax state deposit to be used to restore forest the region.

The law must be enforced in order to achieve legal certainty.

Tripa peat forest must be protected for the sake of our climate stability. The peatlands in Tripa are key to maintain climate stability. It stores 1/3 of the world's carbon reserves. With the potential for high emissions reduction of up to 67%.
