"To the Office of the Prosecutor of the International Criminal Court,
I am writing to bring to your attention a troubling situation that appears to contravene the fundamental principles of the Rome Statute, particularly the prohibition on granting immunity for war crimes.
According to reports from various sources, French President Emmanuel Macron is alleged to have negotiated or attempted to negotiate an agreement with Israeli Prime Minister Benjamin Netanyahu, offering immunity for alleged war crimes in exchange for a ceasefire in Lebanon.
I wish to emphasize the following points:
Violation of the Principles of the Rome Statute:
Article 27 of the Rome Statute explicitly states that immunity, including for heads of state or government, cannot be invoked to escape international criminal responsibility for war crimes, crimes against humanity, or genocide. Any political negotiation offering such immunity directly undermines the treaty’s objectives and obligations.
Disregard for the Decisions and Mandates of the ICC:
The ICC is mandated to prosecute individuals accused of crimes within its jurisdiction. An agreement granting immunity for such crimes interferes with the Court’s mission and compromises the impartial enforcement of international justice.
Violation of Victims’ Rights:
Granting immunity—explicitly or implicitly—to individuals accused of war crimes is a betrayal of the rights of victims, who rely on the ICC to ensure that perpetrators of such atrocities are held accountable.
I respectfully request that your office launch a thorough investigation into these allegations to determine whether such an agreement was proposed or concluded, and whether it constitutes a breach of France’s international obligations under the Rome Statute.
I am available to provide additional information if necessary, and I would like to underscore the critical importance of upholding international justice in this sensitive context.
I look forward to your response.
Sincerely,
